What is the easiest, fastest and the most certain way to become a resident? I have tourist visa, I'm in US now (visa is still valid). My boyfriend (US citizent) and I want to get married, but we're not sure what is the best way. Should we get married now, when I am on turist visa and applay for green card or first I should go back to Poland and applay for fiance visa? What is the fastest and the safest way? How long does it take? I would like to start school soon in States that's why time is so important to us. I am begging for help!

If you didn't enter the US with intentions of marriage and didn't know him before yo arrived in the US then you can marry now and stay here. You/he will have to file a I-130,I-864 and a I-485 to adjust status.

If you came with plans of marriage to him and do so that's visa fraud.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

The fiance visa is safe but not fast. I expect it would take even longer with you being from Poland (no offense, but CIS seems to be particularly careful about certain parts of the world, your part of Europe being one of them).

Getting married on your current visa will be fast, but may cause problems with Adjustment of Status. Nevertheless, it's been done before. When adjusting your status, you will have to prove that you did not enter the US with intent to get married, but it just happened that way. If you have a real relationship, it probably won't be a problem, but you might wanna talk to a lawyer about that. The length of time you've been in the country also matters in the equation, e.g. if you've only been here a month and already have plans of getting married, CIS may think it's suspicious.

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

I've been here for 3,5 month... by the time we supposedly get married will be probably close to 5 months...

When I arrived to States I didn't know that we would want to get married, but of course I knew my boyfriend before I came to US.

If you came to visit your boyfriend, but decided you wanted to marry and stay after you got here, you can do that. File I-130 concurrently with AOS.
