HELLO ALL,

FINALLY MY WIFE IS IN UNITED STATES IN K-3 VISA. NOW MY QUESTION IS WHAT ARE THE FORMS DO I HAVE TO FILL UP TO ADJUST THE STATUS

ARE THESE THE FORM?

Download the Following Forms:

1. G-325a

2. I-864

3. I-485

4. I-765 (optional)

5. I-131 (optional)

DO I HAVE TO FILL UP ALL........OR ONLY THOSE THAT DOESNT SAY OPTIONAL.............CAN I FILE ALL AT THE SAME TIME OR NOT?

BESIDE THESE IS THERE ANY THING I HAVE TO TAKE CARE OF?

WHAT ABOUT SOCIAL SECURITY NUMBER AND THINGS LIKE THAT?

APPRECIATE YOUR HELP IN THIS MATTER. THANK YOU.

September 2007 - filed I129F

April 24, 2008 - interview and VISA APPROVED!

May 02, 2008 - visa in hand, had the CFO stamping done at once, bought ticket online...

May 03, 2008 - flew to US to be with stinky love...

July 22, 2008 - Sent AOS Package to CHICAGO Lockbox

July 24, 2008 - received package

July 29, 2008 - NOA for AOS and EAD

Aug 01, 2008 - Touched....

Oct 01, 2008 - Received EAD

still waiting on AOS

K-3 is a multi entry visa so I-131 is not needed until the visa expires.

Yes do I-765 for work permit, it costs nothing when filed with I-485, using CODE (C )(9 )

From the I-131 directions (PAGE 1):

NOTE: If you are in the United States and wish to travel abroad, you do not need to apply for advance parole if both conditions described below in numbers 1 and 2 are met:

A. You are in one of the following nonimmigrant categories:

  1. An H-1, temporary worker, or H-4, spouse or child of an H-1; or
  2. An L-1, intra company transferee, or L-2, spouse or child of an L-1; or
  3. A K-3, spouse, or K-4, child of a U.S. citizen; or
  4. A V-2, spouse, or V-3, child of a lawful permanent resident; and
B. A Form I-485, Application to Register Permanent Residence or Adjust Status, was filed on your be half and is pending with the USCIS.

However, upon returning to the United States, you must present your valid H, L, K or V nonimmigrant visa and continue to remain eligible for that status.
