Having children overseas.

Hi. My wife arrived 2 months ago, received her green card, and is applying for her social. She is pregnented for 3 weeks and we plan to have her return to Vietnam to deliver the baby. Am a US Citizen of course and I was wondering about the complications involved in bringing my child back to the states. Anyone have an advice? THX

Overview

The Child Citizenship Act of 2000 allows certain foreign-born, biological and adopted children of American citizens to acquire American citizenship automatically. These children did not acquire American citizenship at birth, but they are granted citizenship when they enter the United States as lawful permanent residents (LPRs).

You will register the birth at the consulate overseas, the consulate will issue a US Passport for the child to travel back to the USA, the child will be considered to be a US Citizen.

The OP said "Am a US Citizen of course" Only one of the biological parent's needs to be a a US Citizen to register the birth at the foreign consulate to claim US citizenship for the child.

Hi Dan,

I completely agree with your point in general. I think we both made an error in not asking the OP what his situation is - in terms of the residency requirement (overview in the link you provided).

I assumed he may not meet the requirement - you assume he does (guess we tend to base it on whichever we are familiar with).

I'm a U.S. Citizen and I don't meet those residency requirements. Just my thoughts.

LostAtHome, my first obvious question is this: Since you say that your wife is in this country armed with green card

and pregnant for 3 weeks..then why are you planning to send her overseas to give birth, when she is in the US???

Your othe question as to whether complications will arise in your attempt to bring the child to this country.

You are a U.S. citizen, and as such under federal law ... with few exceptions, mind you.....your child is under

this law, a U.S. Citizen....remember, you have to meet some hurdles to achieve this.

You must show by convincing documentary evidence, that you were physically present during the time period

that the child was born over seas. In other words, you have to show you were there, for some period of time even

prior to the childs birth.

You have to do the same convincing documentary showing that you were physically present in the U.S. 5 years

living here, before you went to the place your child was born.

Be sure to document papers showing that you were living for some time at the location your child was born, and

papers showing that you were there physically, perhaps papers like Baptism, which most likely requires you to be

there. It is not really that easy. I am a USC. Yet I had to prove that too. With the right papers you can too.

I had that same problem, and solved it pretty easy...with the right papers. Keep in touch in case you need further

tips.
