Possible Divorce... need help!!

Hi all. Here's the deal:

Brought my wife over on K1 in June 06.

Got married in July 06.

We've been married 14 months.

She got her AOS / perm resident card a few months after we got married (maybe Dec 06?)

We're having some serious problems which I won't go into. We're contemplating divorce unfortunately.

If we get a divorce, will she have to go back to her native country? I really don't want that to happen.

Does anyone know what the laws are? Does she have to be here a certain time or have her perm res. card for a certain time/be married for a certain time...etc...? I live in NJ.

Appreciate all your help.

:(

J

winterr,

If she received her conditional green card in December 06, how could she have applied to remove condtions already? That is done 90 days prior to the 2 year anniversary of PR, which in this case would be in Oct 08.

She can remain in the USA, if a divorce occurs shortly after receipt of PR, IF she can demonstrate that the marriage was bona fide. Naturally, with an USC spouse that is keen on seeing his soon-to-be ex-wife preserve her residency, this shouldn't be difficult to accomplish, if he is willing to supply an Affidavit and the appropriate documentation.

You can 'catch' me on here and on FBI.
