Timeline

My son and I arrived July 26th, filed paperwork for AOS and AP 07/28/07 (received 08/01/07).. they are just processing mine now and sending back my sons for lack of signature (I signed part 5 and not under Applicants Certification).

My sons grandfather (my ex-father in law) is seriously ill ... he's been having treatment for lymphatic cancer for forever and soon he must have either a bone marrow transplant (if they can find an appropriate donor) or undergo another round of aggressive chemotherapy .. which seriously I don't think that he is going to be able to physically endure. What are my chances of obtaining an emergency advance parole so that my son can spend some time with his grandfather during this time? (of course obtaining a Dr's letter describing the seriousness of his medical situation)

Met in Cleveland 07/07/05 ... Fireworks!!!

Emails and phone calls until first visit back September '05

Many trips to Cleveland and overnight stays in New York

Engaged 05/07/06

07/18/07 - Interview yeeehaaa .. approved

07/26/07 - received Visa from Montreal (should have received 07/24)

07/26/07 - POE Buffalo, NY (Peace Bridge) .. No EAD stamp

07/27/07 - Beautiful marriage .. now you may call me Mrs. :)

07/28/07 - Filed AOS,EAD, and AP for me and AOS and AP for my son via UPS .. received 08/01

08/16/07 - applied for ssn

09/03/07 - received ssn card

11/07/07 - AP approved and received 11/12/07 :)

11/19/07- EAD approved online and received same day (actual approval 11/07/07) :)

12/27/07 - AOS transferred to CSC

02/26/08 - 485's approved without interview

01/14/09 - Sent I-751 - removal of conditions

02/23/10 - Biometrics

03/17/10 - Removal of conditions approved .. card production ordered

You would need to file an infopass with all of that information. There was a person recently who got approved and they posted what to bring. I would recommend you do a search here on VJ and read up

I've read where some receive it without great difficulty and some where they were denied even with valid documentation. It appears to depend on the officer handling the request. I was able to obtain mine based on discussion with the officer and providing the hospital and attending physician's documentation, which I had faxed to me. One thing's for sure.... the chances are nil if you don't try.

Thanks for the reply .. I was hoping that anyone that has requested and obtained an emergency advance parole for a situation similar to this one would come forward and post their experience ..

I've been to the Cleveland USCIS office a couple of times now so the officer is familiar with my face. They had to track my package and get back to me regarding AOS, EAD and AP for myself and my son. Mine is going through after being there since 08/01/07 but my sons is being sent back as I signed on the wrong line.. the officer called me to tell me that this morning. So ... hopefully the officer will have some compassion to the situation and once I resubmit his package and get NOA2 she'll give us the emergency AP due to the delays we've already experienced ( as well as with legit proof of his grandfathers medical condition) ... it's soo sad .. will most likely be the last xmas with his gramps .. and he's an only grandchild.

I've yet to figure out why USCIS cares whether K1s come and go to the US so much before getting a GC.

What's the reasoning?

Sure isn't fair for peeps with emergencies back home. They used to make money for filing an AP but that has changed if you file for AOS.

Yeah I know! USCIS tain't fair! :blink:

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
