I34F sponsor question??

Timeline

Just wondering if the sponsor has to have be a individual with that amount over poverty level? My Finance lives with his eldest son. With a combine household income we are well over the limit. Is it possible to use the combine household income, or do we have to find a sponsor. (which isn't a problem), just my finace owns his own business and doesnt report all his assets, so he doesnt make over the limit for a family of four. Does anyone know, please let us know..Thanks Lee

For the visa the sponsor or co-sponsor needs to exceed poverty line, counting all the sponsor's or co-sponsor's dependents and the foreign fiancee.

Does your US Citizen Fiancee claim eldest son as a dependent on his IRS returns? If he does not, then he does not count that boy on his I-134.

Only count DEPENDENTS as household members in the I-134, a person can live in the same home but can not be counted as a household member unless the person is a dependent on the head of the house.

Actually YES, as as long as son makes 125% poverty line counting himself and your daughter. Your fiancee will then just sponsor you, and count his dependents except his eldest son, if his eldest is no longer counted as a dependent on his tax returns.
