apply for K3 while in USA?

I noticed that on the I-I30 form question 14 asks if the relative is in the usa at the time of application and how long they are authorized to stay for.

Does this mean that I can enter the US from the UK on my visa waiver, get married, send off my I-I30 and I-129 while I am still on my visa waiver and then return to the UK after 90 days to complete? Or do I have to return back to the UK first before I can send off the forms.

The I-I29F forms have that same question and they allow you to apply whilst on your 90 day visa waiver.

Any advice would be great!

Yes you can submit the petitions whilst you are in the US on the VWP and return to the UK whilst they process. Many have done that. However if on entry they know that you will be getting married, chances are you will be denied entry. Whilst there is nothing illegal about entering the US to get married, they would look at you as a prime candidate of having intent to immigrate. When I entered I was asked 'business or pleasure'. I responded 'pleasure'. Take plenty of evidence that you will be returning to the UK after the 90 days so you have that if asked. As with any entry to the US there is no guarantee of entry as all visitors are looked on as intending immigrants and must convince them otherwise if questioned.

I think the key is that at POE you answer exactly what they ask and say no more. If you start to elaborate you give them information to deny your entry.
