I-94 clarification needed please...

Timeline

Hi All,

I have a I-94 on a K3 Visa with multiple entry.

I am about to travel back to Canada - do they take the I-94 from me?

If so, do I get another one on the way back into the States when I return

in one weeks time? Please clarify and confirm with thanks, since I am not that

clear on this ...

Yes they will take the I-94 from you because it is a departure record, and you will get another on when you re-enter the country.

Thank you YuandDan...On my way back to the States, (going by car) do i have to tell the border that I need a new I-94 or should they know this

already...If so, does this mean that I will probably have to go aside to obtain my new I-94?

I've also read somewhere that if you go for visits less than 30days that you don't have to surrender the I-94.

If you're crossing by car they won't remove your I-94 because you're going through Canadian customs & immigration, not American. Going back into the US is when they pull the old I-94 and issue you a new one. However, I am not quite sure if this is how they handle K-3's. Hopefully, someone will be along to clarify.

I am not sure about driving in to Canada but when you leave the USA they take your I-94 and you will be issued a new one on your return.

My kids were on K-4's and travelled back to Australia before the K4 expired......they got new I-94's when they came back in. The I-94 shows that you were inspected on admission to the US.

This will only happen when someone departs from an airport. And in some cases, it won't even be removed then. There is no one to "take" the I-94 when driving into Canada because the departing legal resident is no longer on US soil. It gets removed at point of re-entry.

Hi there,

Just to give you a brief update, I crossed the Canadian border yesterday by train, and the border officer did not take my I-94. He asked me when I was returning to the States, and I told him in 1 week. So he said that it stays in my passport. I'll let you know what happens on my trip back into the States next Monday.
