Got EAD Today. Question about exp. date

Got Hubby's EAD card today. Yay! I was looking a the expiration date. It expires in Feb. 2008. This is the date his I-94 expires also. When he came over on the K3 visa, his passport was only valid for nine more months. The lady at the POE stamped his I-94 as valid for validity of passport. Is this why his date on his EAD is the same as the I-94. I am so confused. I thought his card was supposed to be valid for a year.

You filed for EAD before filing for AOS using code (a )(9 ) this type of EAD IS based on the I-94 card, most K-3's have and I-94 valid for up to 2 years, in your case your I-94 was set to expire same as passport.

EAD filed with or after AOS using code (c )(9 ) based on I-485 filing is a 1 year EAD.

Okay, Thanks so much. We are currently doing AOS so what happens if his I-94 expires before we get the greencard approved?
Nothing happens when I-94 expires, just apply for another EAD when you file the AOS, EAD with AOS costs nothing. One fee $1010 pays for the EAD and AOS.

Also if the K-3 visa expires you will need a new passport, and apply for AP (I-131) to be able to travel out of the country while waiting for the AOS.
