MORE TROUBLES WITH THE SSA

Timeline

A long story short: My wife came here on a K-1. After we got married we went to the local SSA office and had a heck of a time getting her a SSN and card. Eventually we managed to get he a SSN and card but it was in her maiden name.

We received her authorization for Employment form USCIS and yesterday we went back to the SSA office to get her name changed on her SSN card.

The lady at the SSA office tore up her SSN card and said there was some type of name problem between SSA and USCIS. She gave us a letter saying that they needed to verify the authenticity of the documents I brought with me and it could take up to 4 weeks to get a new card, if we get a card at all.

( I brought her passport/visa, Authorization for Employment Card from USCIS, Military Dependant ID Card, Marriage Certificate, etc).

I called the SSA and go thte typical B.S. you get when you call a GOV agency.

We then headed over to the MVD/DMV to get her Drivers License. They wouldn't give her one because she did not have her SSN card.

I am on the verge of suing the SSA.

IT takes 2 weeks or more for USCIS to update the database that SSA officer uses to confirm a person's immigrations status.

You have SSN, and you have EAD no need to change the SS Card until after getting the Green-card.

Now you will have to wait for SSA to confirm immigrations status and send out a new card.

You can still get a job using the EAD, and if you know the number that was on the card you can provide that number for the employer, and tell them that the card is in the process of being replaced.

Most states DMV require to see the SS Card.

THANKS YuandDan DMV also said that the SSN card needed to be in her new maried name and not her maiden name or they would or could not issue a Drivers License. Also kind of sucks, because most jobs want to see a drivers license.

Why do you think SSA needed to confirm with USCIS when I had the Authorization for Employment card with me?

It is standard operating procedure to confirm status.

The DMV should have accepted card in maiden name, as long as you provide document showing name change, (Marriage cert)

Hi - it seems like your wife is having a similar problem to what I am having! I came over on a K1 and got an SSN about 3 weeks after arriving here. When we filed for AOS and employment authorization, I used my maiden name as I didn't realise I should have put my new name on the USCIS forms at that point (I assumed that I should use the name I have in my passport to avoid confusion when travelling - I can't change that until I am in Australia and I can't go back to Australia until I have my greencard! ANYWAY ..) When we went to the local SSA to change my name on my SSN card the woman was unbelievably rude and unhelpful and said "no you can't change it because there is a name mismatch with immigration, you're not a US citizen, you can't do it, what do you need it for anyway" despite the fact that I was waving a legal document with my new name in front of her (i.e. our marriage certificate). I was absolutely furious. Luckily she didn't tear up my SSN card! When I got home, I checked the SSA site and she was absolutely wrong according to their own policy document: https://s044a90.ssa.gov/apps10/poms.nsf/lnx/0100203210

I don't have my licence yet and I am worried when I go to get it, they will refuse to issue it in my married name because of my SSN card.

I don't know if the person you dealt with misinterpreted the policies but I would be printing them out and going back in and asking a few questions if I were you!

I had the same problem as well.....got my card quickly when I first got here and when I wanted to change my name on it it took forever. They told me they had to send a bunch of stuff over to the USCIS for verification or something and that seems to take forever. I actually went back to the SS office after I couldn't get my state ID and a very nice lady did something on her pc for me and send everything they had on record of me through an email system and within 3 weeks I had my new SS card.

By that time your immigration status was updated in the SAVE database system and the lady at SSA was able to confirm status and order your card.

Anytime immigrations status changes it takes a few weeks to change in the SAVE system.

You think that is bad? I just went to get my SS card on friday after my green card interview. The lady gave me a piece of paper saying I would get it in the mail in 13 weeks because they are backlogged.

Sorry to hear that you guys are having a rough time. Hopefully it isn't super important she gets a license right this minute. If you have an EAD, you usually have to provide a ssn as more proof of your identity at the dmv.

We also went back to SSA after Claudeth received her EAD and it took about six weeks to get her new card with her married name.

DO NOT DO NOT give them your SSN card until you get the new one. Say the dog ate it. LOL

2. Card Returned With Request For Replacement Card or New SSN

If the applicant has a card and requests a replacement card (duplicate or corrected) or a new SSN:

-- Ask the applicant to return the old SSN card. (If the applicant does not have the card with him or her, remind the applicant to return the old card to SSA for destruction or to keep the old card in a secure place [not in a wallet or purse]).

NOTE: Do not forcefully confiscate the SSN card if the applicant refuses to relinquish it. Similarly, return the old SSN card if the applicant requests that it be given back.

What the SSA office did sounds like they followed procedure. Now following up on things is going to be up to your wife.

When an alien requests an SSN or replacement/corrected SSN card, SSA will verify his or her documents and current status with the appropriate Bureau of the Department of Homeland Security. If the initial verification is not available through the Systematic Alien Verification for Entitlements (SAVE) system, SSA may need to send Form G-845 for manual verification.

However, for applications submitted after 01/06/2007 SSA offices can submit an additional electronic verification request, that in most cases eliminates the need for a Form G-845 to be sent. However, the response to the additional electronic verification request can be to send copies of the immigration document(s) under cover of Form G-845.

If your status does not verify through the initial SAVE request be sure that the secondary request has been made and return to the SSA office no more than once a week to see if the SSA office has received a response from the secondary verification request. If the G-845 is sent wait two weeks and start checking once a week for a response. Be sure to take your document whenever going into the SSA office.
