K2 Visa for Child/Father's Consent Required?

My fiancee has a 3 yr. old son who will be coming over on a K2 visa when we hopefully get our K1 approved. I know you have to have the other parents consent, but the father is not around and he is not listed at all in the childs passport or anything. I have been told by asking around that as long as the father is not documented in the passport, permission is not necessary and there should not be a problem getting the K2. Has anyone experienced this themselves or know others who have been in this situation? Am I getting correct info? Thanks for your feedback, as always.

Is he listed on the Birth Certificate?

Your best bet is to email the Embassy and ask. Certain Embassies will require a Court Order.

No, he is not listed on the birth certificate.

This is a simple process to solve. I have done it myself. Have you fiancee go to an attorney. At the attorney asked that the fathers parental rights be taken away on the grounds of disinterest and abandonment. The Ukraine expects both parents to raise a child and if one parents disappears the other parent can have the parental rights removed.
