You guys are probably correct about the length of stay. Its great that I've asked questions here. Also it sure was a suprise to me that she was granted a B2 visa since she is a Chinese national.

What zyggy stated does make some sense... For the K1 process, there do ask if she has been in the US before, and I'll say she will be in the US instead of "HAS BEEN"

Darn... One step at a time for me... I will still attempt to see if I can get the B2 to stretch to 6 months atleast. Then 6 months apart since K1 takes one year to finish. Right?

As zyggy stated, it's rare that a visitor will be allowed in for a six-month stretch; a six-month ticket is practically a "red-flag" for the inspecting officious.

However, it IS possible to enter on 90-day B2 and then extend it to 180 once in US (so long as you don't mind forking over almost US$200 to USCIS).

I could be wrong, some one correct me if i am, but i thought the NON USC can not come into the US during the K1 process, that they can enter AFTER the approval.

If the fiances were able to come in the US on visitor visas WHILE the K1 was in process and sit it out, im not sure most of us would have been apart for a year or more.

even if some POE let you enter without checking if theres a K1 in process, though from what ive heard most check and denied entry.

I could be wrong, some one correct me if i am, but i thought the NON USC can not come into the US during the K1 process, that they can enter AFTER the approval.

If the fiances were able to come in the US on visitor visas WHILE the K1 was in process and sit it out, im not sure most of us would have been apart for a year or more.

even if some POE let you enter without checking if theres a K1 in process, though from what ive heard most check and denied entry.

Nothing to stop you trying to enter on a visitors visa, I did a 3 month stint myself whilst waiting.

I have no idea what the stats are, usually when this comes up most replies are from those who did without any big isue, with a few who had problems.

Whether you get quizzed and can satisfy the non immigrant intent at that time bit is another matter and down to individual circumstances.

My fiance is studying in the UK but is from Vietnam. Here is what the consular office at the US embassy in the UK said when we asked whether she can apply for a k-1 from the UK...

'If your fiancee has leave to remain in the United Kingdom for the period of time it will take to process her application, then she may have the K-1 visa processed through the Immigrant Visa Unit in London. '

I am not sure who needs 1 year for the K1. Have a look at my timeline. My interview is at may 22nd.

I entered twice while the K1 was in process. But of course it can be different depending on which country you are from and other details that might be interesting to USCIS.

A person can come to visit on a B2 visa. They cannot (are not supposed to) come to take up residence in advance of getting a proper visa to take up residence or a visa that allows one to 'sit it out' (a K visa) while waiting for approval to take up residence.

Visiting and 'sitting it out' are two different things.
