Not yet he hasn't.

Did I misread it? The judgment was for him to forfet $49K and have 10K returned.

He declined the deal. It is in appeal now. I spoke with his lawyer an hour ago and it is now in the Federal Appeals Court in Atlanta. If he had accepted the deal and split for home then the case would have been closed. Instead he has (foolishly I believe) opted to roll the dice and hope for a better outcome. While I hope he gets more I do not see it happening, but stranger things have happened in the past.

You contacted his lawyer? Ok, I didn't know you had a personal involvement in this. In what capacity may I ask?

Curiosity. Wanted an update and could not find one anywhere else.

I choose not to leap to conclusions on this case and instead search for the facts. It will be a landmark case and affect many aspects of immigration and money transfers. It is far bigger than a poor schmuck getting busted with a few thousand dollars.

This case will set a standard by which many cases to come will be compared to. So any decision made here will have lasting impact. That is why I did not jump on the band wagon and say just take his money and kick him out or give him his money and put him on the next plane. this one will have to be by the book and if not, the Appeals Court will write a ruling, and that will set a new standard. History is being made.

Latest update on Mr. Zapeta. Oral arguments next month in Federal Court. Will follow up with the outcome when available. Someone actually wrote him a little song... Zapeta's Song I'm still on the fence, I believe punishment is warranted but not the kind the Government has tried to deal to him. Just my opinion.
