Interim GC After 2 Years of Marriage

Hi All,

I am in very precarious situation.I have been married over 2 + years,My Interview was over in Feb'05 and My status was kept Pending until yesterday,As they Approved my GC Today and sent me 2 Year GC.

Since we have been married over 2+ years..does it seems Right to wait Another 2+ years or Shall I Protest?

If So who should i bring this Notice To?

did you file before the second year anniversary or after the second year anniversary. if you filed after the 2nd year anniversary, then you get the 10 yr, if before the 2nd year - then you only get a 2 year --- that's my understanding.

I'm not sure if that's right. My husband and I filed one week after getting married and he got the 10 year card, because it took them longer than 2 years to get to us. I'm not sure why turtle is having this problem. It's my understanding that if you've been married for longer than the 2 year conditional term, you receive the 10 year green card. However, there isn't a lot of information in his post, so it's hard to know exactly what's been going on with his particular case.

Looking at your timeline, the interview was held within two years of your wedding date.

Provided that the RESIDENT SINCE Date on the card shows the date of your interview and not a date later than your second wedding anniversary, a two year card would be correct.

Based On this I lost My Hope as My Interview fall with in 2 years of My 2 nd Anniversary

I was under the understanding that if your case was approved after the 2 years you would get a 10 GC. I am not sure though!!!

It depends on why the case remained pending after interview. My wife's case remained pending for three weeks after the interview because they needed new biometrics, but the date of approval on the card she got is the date of the interview. If the case is held open for FBI check or biometrics, my understanding is that the approval usually is backdated to the date of interview.

If the RESIDENT SINCE date on the card is after the 2nd wedding anniversary, then the OP would have a case to file an I-90 and get it corrected to a 10 year card.

Perhaps just make an InfoPass to ask about it. Congrats on getting the card even if it's the two year card.

Check your "Resident Since" date. If it's before your 2nd anniversary, then you get a 2-year GC. If it's after your 2nd anniversary, then you get a 10-year GC.

However, I have seen it posted here that sometimes USCIS still gives out a 2-year GC even if the couple has been married for 2 years especially for K-1 cases. Hopefully, someone who has more concreted info will post here too.

Congratulations on the card. If there is an issue, make an infopass appointment and ask a few questions. It can't hurt to have clarity.
