Hi, Everybody!

Thank you all for your replies/comments to my previous questions. We are assembling our AOS package and have question about supporting evidence (joint accounts, bills, photos, etc). Do we need to provide it all when we file for AOS or we need to provide it at the interview?

10/22 NOA date

11/21 Biometrics taken

11/25 touch on AOS and EAD

12/06 Interview Letter produced (12/10 in mail)

12/11 touch: EAD card ordered (approved in 60 days from filing)

12/11 touch: AP approval notice sent (approved in 60 days from filing)

12/15 AOS Interview Cancellation Letter received in mail...

12/17 AP received in mail

12/18 another touch on EAD: card ordered

12/20 EAD approval notice sent

12/21 EAD card in mail

01/28 second Interview Letter

03/25 AOS Interview - APPROVED!!!

Timeline

Some support eveidence needs to be filed with the AOS package such as support evidence for your

Affidavit of support, you will need to send in copies of recent tax returns, copy of paystub

and statement of bank account

For the interview you need to provide documentation showing co-mingling of finances ( such as joint utility bills, banks accounts, insurance ect..)

Each form for the AOS package has specific instructions on what needs to be filed with it as support evidence.

If you are filing with a concurrent I-130 you will need to submit evidence of bona fide marriage docs, but if you are adjusting from a K1 (as in you were married prior to expiration of the I94) then the documentation would be accepted at the interview (if there is one)

The types of evidence you are talking about is not sent with the AOS package, it is brought to an AOS interview.

We followed the VJ AOS guide.

Assembling the I-485 Package: Checklist frequent questions frequent questions

Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.):

  1. Payment(s) as required by USCIS. Be sure to include the payment for both the I-485 and the biometrics fee*. Use a money order so you can track the payment. If a personal check is allowed, use that instead.

    >> The fee for I-485 applications filed on or after July 30th 2007 includes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication -- as long as you paid the "new" rate for the I-485 effective July 30th 2007).

  2. Cover Letter. Should include a description of what your are petitioning for (I-485), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.
  3. Form I-485: Petition for Alien Relative
  4. Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps).
  5. Copy of the non US Citizen Spouses K-1 or K-3 Visa from Passport
  6. K-1 Visa Holders: Submit Copy of NOA2 "Approval" for I-129F

    K-3 Visa Holders: Submit Copy of NOA2 "Approval" for I-130

  7. Copy of the non US Citizen Spouses valid I-94 (front and back copies)
  8. A copy of the intending immigrant's birth certificate along with English translation. (If in any language other than English)
  9. A certified copy of your marriage certificate. (If filing for your spouse)
  10. A copy of the petitioner's and/or intending immigrant's divorce documents. (If filing for a spouse, and one or both of you have been divorced before)
  11. A copy of a prior spouse's death certificate. (If filing for a spouse, and one or both have you were married before, and the prior spouse died)
  12. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.
  13. G-325A (all four pages) filled out,signed and dated
  14. I-693, Medical Examination of Aliens Seeking Adjustment of Status. (If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)
  15. I-864, Affidavit of Support (see poverty limits here)

    >> Include any additional required supporting documentation

  16. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

    >> Include any additional required supporting documentation or photos as well as payment as noted here.

  17. I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed (optional)

    >> Include any additional required supporting documentation or photos as well as payment as noted here. Relationship evidence is not asked for in the I-485 directions and are not noted in the VJ Guide.
