I keep reading about form I-130 in regards to petitioning a relative but I am petitioning for my fiance. Our NOA form is an I-797C. Does anyone have any idea which box I should check when completing the Affidavit of Financial support. As of this moment I have selected box A. Please help!

I'm not sure what you've applied for. Did you petition to get your fiance here in the states? If that is the case, you should have sent in the I 129f and supporting documents.

Or is he here in the states now and you've sent in an I 130 (in which case it will be denied as you are not married)?

Are we talking about form I-485 or form I-864???

I-485 Check Box (c )

I-864 Check box (a ), the immigrant is no longer your fiancee, they are now considered a relative ( SPOUSE )

We used I-864EZ, it is simpler to understand, (We had no need for a joint sponsor, use of assets, and was sponsoring only one person)

Finally keep in mind your spouse is first counted as IMMIGRANT, not a SPOUSE on I-864.

DO A TIMELINE, I see applied for K-1 in your profile, but you are talking AOS, sh profile should be showing AOS (APPLIED) and your timeline is no help in clarifying your post.

Easy to get confused and think I-134 for K-1 visa or I-864 for AOS.

We sent in the I-129F and it was approved. We had our interview got the K1 visa and have already gotten married. Now onto the next step, AOS. It's just I'm confused because the affidavit of financial support I-864 doesn't appear to give an option for me. Perhaps my additional information might help. Thank you so much.

If you're married, she's not your fiancee any more - she's your wife.

You check box "A".
