I was still married when I met my husband. It ain't no secret around here.

Welcome to the Scarlet Letter Club...........you'll be just fine. There's loads of us.

Not sure where you get the scarlet letter idea. There are practical problems that often come up in the visa process for relationships that begin when one or more of the parties is married. Any judgment made by a Consular Officer shouldn't be a moral one. (Can't speak for what actually happens.) The issues generally involve extra scrutiny to rule out fraud, not moral labels. Some sail through easily. Others go through more hell than you want to imagine. Most just answer a couple extra questions and make extra certain their bona fide evidence is in order.

In this case, the couple can't use the VWP during the visa process because that option was exhausted before they could start the process. No need to imagine nonexistant moralizing when the practical issues are so real. Also no need to pretend the emporer has new clothes.

From my anecdotal readings, I would say extra scrutiny to rule out fraud (red flag/recent divorce) is more likely to occur at high fraud posts. I've never read of this being an issue at any consulate where English is the first language of most beneficiaries.

Yes, fraud related extra scrutiny is more likely to occur at high fraud posts, no matter what the reason for the scrutiny. Like I said, for some, it is nothing. For others, it is nothing more than an extra question or two. For some it is more hell than you want to imagine. For this OP, it means they used up his VWP option before they filed. The result being the possible relocation of some children or just more time apart than they would have spend otherwise. The issues are practical and/or extra scrutiny related. No scarlet letter. No moral issue. Please give it a rest.

You need to get a thicker skin.

Yes, thank you. He did that last year and he's doing it this year too.

I was denied entry when I tried to enter the 4th time within 1 year. The officer told me that a tourist visa wouldn't be worth since I had intentions and I was in there system now.

Also he mentioned that a tourist visa is the same processing time.

Hej :)

You were denied after the 4th attempt to enter the country within 1 year ? How long have you stayed on the three previous stays ? And, have you filed your K-1 application at that time already ?

I'm just getting a little bit nervous, because in November, I will travel to my fiancee for the 5th time in a one year period (each visit never exceeded 10 days). I always thought that getting admitted or not is mainly a matter of the time you spend in the US, not the amount of entries per year. By the way, we did not file any petition or visa application, because we want to live in Germany after the wedding.

Regards,

Daniel

My current skin got me through the visa process so far. How is it you think a thicker one will help me get my wife and daugher through AOS? How will it help the OP? How is your comment on topic?

Maybe thickening your skin would have helped to keep the thread on topic instead of all this scarlett letter talk.

Well, i'm resurrecting this post from the depths of the VJ servers to let you all know that we have filed our petition!

When I first posted back in September the road ahead looked quite daunting. So many of you responded to my posts and questions and I knew right away this place would be a lifeline for us! I've learned a lot in these 7 months! My divorce was FINALLY final on Monday and we sent the petition overnight on Tuesday! It was signed for by Paul Novak today at 1:15!

It's been such a long road for us already but we persevered and now we are on to the next chapter. Thank you all for your help and support to get us to this point! It means all the difference in the world to have the support to not only do this right but also just to know we are not alone.

Thanks again.

I've only just seen this ..and I admit I was holding my breath there for a minute!

I have permanent residence status here, and it was no piece of cake to get, so I'm glad to get to the bit that says you didn't go there!

I'm right behind you in the process Kim ... :)

I can explain it to you. But I can't understand it for you.
