I think the residency issue will be problematic due to previously mentioned parental requirements here in the USA

Residency issue?

The DOS has established a requirement that in order to file DCF, the USC be resident in the foreign country for a minimum of 6 mos.

The petitioner resides in the US, so doesn't qualify for DCF.

Kim - Applying for and being denied a tourist visa will have no bearing on your fiance getting a K1 visa.

Regarding 3rd party country visits, just meet somewhere other than the US. For example, I am meeting my fiance in Canada next week for a few days. You shouldn't have any issues meeting up somewhere, aside from any financial constraints.

Yeah, its hell waiting, but it will be well worth the wait!

I'm aware of that. But I think it's up to the Mom to decide if she can pull that one off.................

Tracy, it does not matter when and where we are married at all.

He has my heart. All of this bureaucracy is merely for goverment.

Julezabelle... then we shall apply for that visitors visa to see if he has a chance of even coming back to me for a short time. It's just too hard for me to be away from my kids (15/12).

I'm a little confused with the other discussion that is going on. Are you talking about me going there to be with him with my children until we are approved for 'whatever'?

Anything is possible at this point. I work for myself and mostly online so I can, and have, worked from abroad before. My family, including my 'x', is supportive of this relationship and helps in any way they can...including financially. My only problem would be my children's schooling. I am not opposed to schooling them myself BUT it is an issue we have not even addressed as of yet.

To apply for DCF, which CAN be quicker, you must be a resident of the foreign country for at least 6 months. You stated you didn't want to be away from your kids for that long.

Right on!! :) That is exactly how we felt.

It is called direct consulate filing or DCF. If you can live in NZ for the consulate required time (typically 6 mos or more) then you can file the I-130 directly with the consulate and thereby avoiding the USCIS service center backlog and the NVC processing.

They are discussing Direct Consular Filing (DCF), which means you'd marry in NZ (or where ever), live there together for 6 months and apply directly with the US Embassy there for your then husband to come to live in the US with you.

...or live together for 6 mos. and then get married or any combination in between... The key is a 6 mo. residency (or whatever the consulate requires) in the foreign country before the filing of the petition can occur.
