Visa/Immigration for Husband's Parents

My husband and I've been married for 2 years and we are now currently 7 and a half months pregnant.

My husband came here in a K-1 Visa.

Seeing as how I'm pregnant we decided that we would need more help and his parents agreed to come to the US from Korea.

Just visiting allows them to stay for no more than a month.

We would like for them to stay for 3-4 months at a time and apply for something that would allow them to come whenever they pleased. I'm assuming Immigration (not Visa) would work better.

Which is why I'm writing here. Would it be better for them to get some sort of visa for them to visit for lengths at a time or fill out forms for immigration.

And if either or, which Forms are we supposed to fill out.

Are we supposed to go with the Petition for Alien Relative??

It says that only the US Citizen can sponsor parents, but seeing as how they're only my in-laws and NOT my parents, I don't think that's an option.

Any advice would be much appreciated.

Timeline:

March 22, 2005 - Sent in Petition for Fiance Visa (i-129f)

March 29, 2005 - Had to resend petition (insufficient stamps)

April 8, 2005 - Attempt #3 sending Petition (is there an unknown conspiracy against me? i put $3 worth of stamps and it's returned to me)

April 21, 2005 - Received Receipt for k-1 visa (NOA #1) receipt was dated 4/11/2005

May 2, 2005 - Received NOA #2 (finally these people are getting their act together)

May 12, 2005 - Found out that NVC sent in my petition and all that good stuff to Korea on May 4, 2005 (i can't express into words how happy i am)

June 16, 2005 - Looked up our case number online to check our interview date..and our number was there!!!

Our case interview will be on July 14th 2005!!!

July 14, 2005 - Interview. and it was a....SUCCESS!!!!!

July 21, 2005 - My fiance and I are in the US of A FINALLY!! We have 90 days to get married.

September 21, 2005 - Coincidentally, we got married exactly 2 months after.

September 23, 2005 - Starting the Adjustment of Status and EAD process.

You have much to read about this because your questions are all over the place....

Whichever process you do it all will require a Visa... Some visas will require a petition, others will begin with a visa application directly with the consulate.

Immigration by definition would indicate a desire for permanent relocation NOT temporary....

A tourist visa is not necessarily limited to a 30 day stay (can be up to 90 days)

The USC spouse cannot petition for the MIL/FIL. The petition would need to come from the non-USC spouse. A petition from a LPR in many situations takes YEARS as the visas are subject to quota

Unless things have changed, B1/B2 holders are usually given 6 months of stay per visit. I say usually as it's still possible for one to be given less than 6 months.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

01/17/09: Applied for US Passport and passport card

01/28/09: Received US Passport

01/29/09: Received US passport card

You do not file anything.

If they want to visit they aply for a Visitors Visa - B2.

If your spouse wants the to immigrate, that is only open to USC's, so a bit of a wait.

PS I have always wondered how a male can be pregnant! Something for the tabloids?
