Getting second Visa

I won’t boor everyone with details of my case except to say that my fiancé came here to the states about six months ago on first Visa but had to return to her country since her passport was expiring within the first three weeks of her being here. There was a misunderstanding about her coming here on a soon to be expired passport. In hindsight I probably should have married her but there was some confusion about how this would effect her legal status since there was a chance she could have come back on the first Visa but after she returned home and finally got her new Passport she was told by American Embassy that she would have to get a new Visa to come back to the states.

I would like input from people on whither I should hire lawyer on this issue or just handle paperwork ourselves. I hired lawyer to get first Visa. Cost was 1600 dollars and now looking at another 1600 if I hire same lawyer.

Any ideas or thoughts would be welcome.

Yeah this is a lil bit to much to pay for attorney all that money and he still wanna more and for sure he gave u $200 dollars discount this time because u are a customer, well if i am in ur shoes i will do all the paperswork, as u see we learned alot from Visa Joruney people and it's enough for us to make a big legal profession, lol Yeah all what u need to do download the paperswork from Uscis site or from here. and if u see something u dont know all what u need to do is, to post it here and for sure u will get plenty of help. but i cant stop u to hire attorney it was just an opinion, and this up to you, after that if something wrong happend with ur case just call the attorney, the majority of there people did it by themselves.. And yes should to get married the time she enterend to USA, but the good thing she did that she back to her country before her visa expired, and this is a good goal, otherwise if she back to her country with expiring visa, Opps she will never back here agin. till u go marry her there and back to ur country making all the paperswork here, or she will not be able to get her second visa from the embassy there, because they will count her as a illegal person.

My N-400 timeline, I hope it will help - Local Office (Chula Vista Field Office - San Diego)

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

This is a judgment call for you to make. If you can pay attention to details and are willing to study the process diligently you probably will do a better job yourself than some third party would do. You'll have a much more vested interest than any third party.

Facts are cheap...knowing how to use them is precious...

The process isn't difficult. If you don't mind a little paperwork it would probably be better and cheaper to do it yourself.

May I ask WHY you sent her all the way back to her home country for a passport?

May I ask WHY you sent her all the way back to her home country for a passport?

I didn't send her back she went back beofore her passport was to expire. Her people told her she had to be back in her country before her passport expired and they told her that there was a chance that she could come back here on the time left on her visa. This information has turned out not to be correct. She should have come here right after visa was issued but bad weather and illness delayed her from coming right away. Didn't find out until almost right before she came here that her passport was about to expire.

It just seems to me that this episode is going to make getting another visa harder since 'they' are going to wonder why she didn't come here right after first visa was issued or why we didn't get married when she was here though the time was only three weeks. I am leaning toward the idea of hiring same attorney or different one since this issue seems more complictaed to me then when I got the first visa. Many of you on here seem to have your share of doubts about doing the paperwork yourselves.

She told me that when she went to the US embassay for the interview there were many people denied visas' because of paperwork problems.

None of this makes any sense to me. She didn't realize her passport was about to expire until before she left. I don't understand why she'd have to go all the way back to her country to renew a passport. That can be done easily without having to return to your country of origin.

So she left on a visa, and the visa only allows one entry into the US, and thats usually made very clear to you at the POE and during your interview. It doesn't matter what her country says...they're not the ones issuing the visa.

The paperwork isn't brain surgery.

But you both have seemed to make matters a little more complicated then they have to be...sooo maybe you should get a lawyer again. :mellow:

YES i agree why didn't you just renew her passport here? maybe i'm wrong but i dont know of any country that does not do that, thats why they have embassies/ consulats in other countries. Plus you need to get permission in advance from DOS if you are going to leave the USA on a K-1 before you do AOS. What were you thinking dude ?

July 11th 2007 NOA-1 received date on NOA-1 (now at CSC)

July 19th 2007 NAO 1 Reciept date on NOA-1

Nov 21st 2007 NOA-2

Dec 13th 2007 - arrives at NVC

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Tracking:

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

P-3 to interview - 73 days

Interview to visa - 10 days

Filing to visa- 341 days

Russ, my wife is here from the philippines, we have went through the whole process just by using the internet and answering the questions on the forms. A Lawyer is not necessary.

A lawyer was not necessary FOR YOU. However, no one here has any right to say whether a lawyer is necessary for anyone else, that is for the OP to decide on his own.
