married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

Hi everyone

I have AOS interview in october 30th NY the problem is i moved to AZ now how to solve this problem ?

how can i cancel the appoitment or change it.

Man, you can go through the hassle of trying to cancel it and to change your address, and hope you'll get notified of another one, but if you have the AOS interview, that's like the last hurdle you should need to do anything for. Pass it, and you are home free, pending all background checks and stuff.

By putting it off, the best case, it all works out, you stay where you are and you're delayed at least a couple months. Worst case, the change of address goes through, but something funny happens and the local office counts you as missing your interview, which I think then invalidates your AOS and puts you out of status.

I'd seriously consider hopping on a plane for a couple hundred bucks, SWA now flies Phoenix to LaGuardia. For me, the peace of mind would be worth it, if you can scrounge up the cash and take the time.

4/25 - overnighted packet to Chicago (130, 485, 765, 131)

5/01 - NOA date

5/18 - RFE received for 485

5/19 - biometrics appointment

5/21 - overnighted RFE documentation to Missouri

5/24 - notification that response to RFE received

6/14 - changed address on-line, then called

6/18 - mailed I-865

6/19 - all touched

6/20 - all touched

7/06 - notification AP and EAD approved

7/16 - AP letter and EAD card received

9/23 - AOS Interview letter received for 10/29

Yep I know one on another board that moved from California to NY while AOS was in process, they canceled AOS interview at the California office, only to find USCIS closed the case for not attending the California interview that failed to be noted as canceled, the IO in California just noted them as a NO-SHOW.

Moving while anything is in process at USCIS is hazardous.

I can't believe this .. today Lin gets a letter in the mail which was forwarded from our old address. It is a denial Decision for his permanent residence application because he did not go to his interview in CA.

Order of events:

10/24 move

10/25 notice of interview for12/11

10/31 confirmation of change of address from USCIS

11/1 Notice of cancellation of interview

12/12 Decision on application for status as permanent resident - denied for failure to appear at interview on 12/11

Text says " If you fail to depart from the United States proceedings will be instituted to enforce your departure. You may renew your application for status as a permanent resident during such proceedings" .......

In order for him not to be sent back to China I have to file an appeal and pay another $385.00. How @#@#@@# annoying !!!!!!!!

Anyone have to deal with this ####### before? Should I expect this to happen again when we move next month? I am soooooooooo mad right now

7 Months of fighting with USCIS

Hi Everyone:

FINALLY our appeal was processed and they re-opened our case. We recieved the notice saying that the decision to deny our I-485 because we did not attend the interview was overturned and they are re-opening our case and will re-schedule the interview. Now the big question is will they schedule it in CA or NY :rolleyes:

I am hoping we will get our interview soon so we can try to plan a trip to China this year.

Have you filed AR-11 when you moved ?

Well come to think of it, would it be a problem even if he has filed AR-11 ? Would they still interview him/her since he/she does not belong to that district anymore ?

Fly to NY then change the address after the interview.

I filed my I-485 in July 23th in NY then i got my I-797 for the interview in Sep 18th.

I'm with LuckyStrike. You can avoid a world of hurt by just going to the interview. If that won't work for you, then get into an Infopass appointment ASAP to deal with this issue. You may want to do the Infopass anyway.

For those only readying about this issue, not living it, "Do not move during the AOS process!"

We originally expected to move during the process, so used my daughter's address as an "in care of" address and "permanent address". Since the process isn't over, we may still move during it but our timeline for moving has changed. Of course, I had the benefit of reading Woainilin's story beforehand.
