Hey guys need some help for a friend.

My friends sister in law is married to some one from the UK he came over on a Visitor visa over a year ago. They got married and thought that was all there was to it (how little they now) SO he now is trying to get a green card so he can work. My question is How does He get a green card and can he If he has been here for over 8 months illegal. thanks

Unless he came on a J1 with a 2 year home residency requirement, they can file and overstay and any unauthorized work he may have partaken in will be be forgiven.

My husband was a 5 year overstay with unauthorized work, and we were approved back in April. :) Good luck!

Your friend's sister-in-law's husband should not travel overseas until he gets his green card. Neither should he apply for Advance Parole as he might trigger a 3-year bar on re-entry.

Have them read up on the AOS application process and submit the I-485 and I-765 as soon as possible. Too bad they did not realize the need for AOS before the fees went up.
