Well, I think the point being made is that some people believe the law should be changed.

It's worth noting that an American traveling visa-free on a tourist basis in the UK can't get married to a UK citizen in the UK without a fiance/e visa, period.

yep, not anymore anyway... I squeaked in before the law changed and didn't need a visa to get married over there.

As for VWP, I've seen people flaunt here on VJ the fact that they weren't going to do the K1/K3 thang...just come and marry and stay and AOS, here we come. That is definitely a loop that should be closed.

But when we turn to the Hebrew literature, we do not find such jokes about the donkey. Rather the animal is known for its strength and its loyalty to its master (Genesis 49:14; Numbers 22:30).

There are no limits on foreign spouses. If you can marry a U.S. citizen or legal permanent resident (a "green card" holder), you're guaranteed permanent access to the USA.

No limits on LPR spouses, eh?

This reporter needs to do some homework...

If wait times of at least 5 years for spouses of LPRs counts as "no limits," then sure.

Wait or no wait, the clealry defined limit for LPR spouses, minor children and unmarried sons and daughters is 114,200 per year with 70% or better of that going towards spouses and minor children.

In terms of national security, the VWPers are probably not a "threatening" group on the whole.

The people we should be worried about couldn't get here on the VWP anyway.

I got the impression that the article was suggesting extending the wait period for those who married USC's to get citizenship... NOT to extend the amount of time they have to be apart. Honestly, would it really matter to any of you if you had to wait five years instead of three to be a citizen? I really wouldn't think so. I'm sure all that matters to most of us is being with our fiance/spouse :)

But if we're talking immigration reform then let's get serious. The definition of illegal isn't limited to some Mexicans crossing the border. A sham marriage is a form of illegal immigration and well as getting married while on a tourist visa because it isn't the intent and isn't the process.

If marriage fraud is that big of a problem, then let's reform that too.......but all of us here might not like those answers to those problems.

I think we have to admit that we've all seen a few threads on VJ that have made us scratch our heads and wonder how that person managed to get a visa.

Abby (U.S.) and Ewen (Scotland): We laughed. We cried. Our witness didn't speak English. Happily married (finally), 27 December 2006.

Latest news: Green card received 16 April 2007. USCIS-free until 3 January 2009! Eligible to naturalize 3 April 2010.

Just remember that when we say "agreed", we keep in mind that we may have to jump through more hoops as well ourselves. It's a tough line drawn there.

It's not a tough line. More hoops are necessary since marriage fraud contributes to the overall problem.

So then what would be in your estimation then that needs to be done? More backgournd checks? Longer wait for Citizenship? Most marriage fraud that I have heard of.. so taken with grain of salt... is just for the GC.. an LPR can stay that way for as long as they like.. they do not need citizenship.

Marriage on a tourist visa is not necessarily illegal. There is a process for those who marry while on a tourist or some other non-immigrant visa to adjust status. It is a lawful route to pursue as long as the alien did not enter the US under false pretense (with intent to remain and adjust status). ;)

It seems to be a favorite of the illegal support crowd to confuse the legal with the illegal paths of immigration. ;)

But, Reinhard, I think that was merc's point: It's a tactic of the anti-illegal crowd, too.
