I need help! My husband is a USC. I am not; I was here on a work visa. We got married and we filed our paperwork for me to obtain a relative visa. I was approved for a relative visa, but the judge said I must go out of the country and apply at a consulate for the I-94 before they give me my visa. I don't know how to do this or what to do. Any suggestions?

I am a USC and my ex-wife was from another country who was here on a J-1 visa when we met and got married. As I recall, she had to comply with the same type of requirement. What she did was fly to Buffalo, NY and take bus across into Canada where there was a Consulate for her contry nearby (Toronto, I think). It took her a day of waiting while they processed the visa, so she did some shopping, sightseeing, and visiting with fellow countrymen she met at the Consulate. She then returned and everything was fine.

It was years ago, so its hard for me to be more specific. But as I recall, she did a lot of set-up before hand. For example, calling the Canadian consulate to find out when they were open, what processing times were, what the document requirements were, etc. There WAS some nervousness on our part (even after assurances) about what would happen if she got stuck in Canada and could not come back. But that didn't happen.

It was a pain in the a**, but in this instance, at least, it worked ok.

How did this issue ever make it to some kind of court??

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

There's not enough information here. Yes, visas are applied for at US Consulates. There are no US Consulates in the USA. You would apply for a visa at a US Consulate in the country that issued your passort.

I take it you were involved in some sort of immigration procedings in court. That's the information that's missing as well as a timeline of the events in your process. We need a more complete picture to give any more specific guidance.

It's also unclear what was approved. A petition could be approved but that only allows you to apply for a visa at a Consulate. I suspect a petition was approved, not a visa.

  1. Consulates do not issue I-94's.... they issue visas. I-94's are issued at the POE.
  2. You don't apply for a "relative" visa in this type of situation.... you adjust status. Am I missing something?
  3. A judge is involved?.... telling you to leave the country??? :blink:
  4. The US Consulate in Toronto no longer issues visas. It's either Vancouver or Montréal.

I think she could adjust status here without going to some Consulate. This is what I dont understand. Why is this issue in some kind of court???...traffic court??
