I-94 issue

so i was reading up on some things on the internet yesterday and i came across something very interesting. i read that when leaving the US you have to return your I-94 form or they can deny you your next entry because they have no proof that you did not overstay. well of course my fiance had no idea about this and never returned his from when he left in februaury from his J1 visa. he did not overstay so i really dont want them to think that he did! has anyone ever had an issue at the POE because they did not return their last I-94 form and if so how can i prevent this ahead of time??? or if this something that i shouldn't even worry about.

Did your fiancee go through the US Visit stuff at the airport... did he keep his receipt from US Visit... does he have his boarding passes from his flight out... did his destination country stamp his passport when he arrived...

All these prove that he left when he was supposed to and did not overstay... The I-94 is a very little piece of that..

However, he does need to send it to London, KY with evidence of his date of departure.

Zyggy is right. We had to mail back my fiance's first I-94. I always keep the link to the address handy. It is:

How about any of those other things that I mentioned... I know the CBP stamps my passport every time that I enter the US as a USC...

he doesnt have any of those things. they never stamped his passport leaving or returning. he doesnt have a job and he doesnt go to school cuz he was only going to be there(germany) for a couple of months. i dont know what to do!!!!

Does he have a frequent flyer card... his frequent flyer record should have the date and flight information for the miles that were credited. Otherwise, he should call the airline to get a record of his flight and boarding information.

i know i dont understand how he could not have gotten stamped either but he didnt!! we are going to send a bank statement and a copy of his application for health insurance when he came back as our evidence. i called them and they said that it would suffice. did everyone else know that you were supposed to turn in the I-94 form. no one ever informed us and i cannot believe that they didnt. it just seems too important!! i am also goingot call the airline. thanks for you help everyone!!

I read this following quote a while back. It's from this site in the Visa FAQ. has to do with surrendering i-94. maybe not all that helpful but i post it. Information of it is out there that you have to.

5.12.1)...What about visiting Canada or Mexico prior to filing for Adjustment of Status?

A...There is a way for a K1 visa holder to do this, but only if you are not married yet. After marriage, you must have Advance Parole.

If you DRIVE into Canada or Mexico (not fly), and if you do NOT surrender your I-94 (which is normally surrendered upon leaving the United States), you can re-enter the United States before the expiry date on the I-94. One newsgroup participant did that in early 1999, when he was required to take his K2 kids back into Canada in order to comply with child visitation requirements. He received conflicting answers from USCIS (INS) when researching the issue. He left and re-entered the US at the same POE (Detroit, Windsor Tunnel), and consulted with the USCIS (INS) folks there before doing it.

I think when he returned they should have told him about surrending it. doesn't look like ur fault.

Hopefully you don't have a problem. good luck. I have never had a i-94 and don't have evidence at all for leaving the states from any of my visits as i had no passport and didn't fly. i'm from canada and took the bus. I also hope this isn't a problem of proving I left at in a certain time.

i think i saw u posted a topic something similar to this. i'm just wondering what you did and how it went. i'm in the same predicament right now although i have the original boarding passes and stamp in my passport. i'm thinking of sending them what they need but i just want to know first if they sent you any reply when u sent yours. thanks.

Interesting...everytime my DF traveled back to Ireland, the airline collected his I-94 as he boarded the international flight back home. American Airlines even stapled it to the boarding pass once so that it would be collected before he boarded.

We went on a cruise to the Bahamas and went through immigration when we got back. The IO told us the visa waiver program is great but you have to make sure the card is returned. I'm sure you can correct this problem by returning the I-94, maybe with a cover letter explaining the circumstances. I would also check with the airline to see if they can provide you proof that he was on that flight because I would suspect they keep records of their passenger lists.

I have never hard of not getting your passport stamped at customs.He must have some kind of proof.If he flew the airline should have some record of it.

When I returned to the US last May they did not stamp my US passport.

07/16/07 posted I-129f

07/20/07 confirmed delivered by US Postal Service

8/23/07 No NOA1 !!!!

8/23/07 phoned USCIS (told they can't help until after 90 days)

8/23/07 contacted bank to get copy of Cx check...illegable...noc WAC#

tried for weeks to get actual check....not possible, had to wait the 90 days for info from USCIS

10/17/07 Phoned USCIS, got thru (!), got WAC number and NOA1 date!!!!

07/26/07 NOA1 (never recieved hard copy, was promised a copy would be sent)
