Do I have problems?

Hi there - I haven't been online for a while and am now regretting it as I seem to have fallen behind with filing my paperwork.

I entered the USA on a K1 on Dec 12th 2005. I got married on March 3rd (within the 90 day limit). I have only just come to file my AOS paperwork but have since read that I should have filed my EAD much earlier than now. I had a large amount of money saved up and as yet haven't had to work (though I have two job offers that I could start straight away).

Should I now just file the I-485 or both the I-485 AND the I-765 as it looks like I can only file the latter within the 90 day limit.

Any ideas??? It took so long to get the K1 visa (as you all know) and I pray that I haven't stuffed it up by doing this.......

Get your apps out ASAP, and you should be fine. You should submit the I-765 WITH the I-485.

If you had filed the I-765 before your I-94 expired, your EAD would have expired at the same time as the I-94. So, you were right to wait.

The is no set time limit for filing your AOS just as long as you were married within the 90 days....

You will need to file for your EAD with your AOS... but dont panic you have not messed anything up...
