Ok, quick synopsis: My wife entered illegally on a fraudulent visa and we are going to file to adjust status and get denied in order to file the wavier.

On the i-485:

Part 1. (Information About You) - What do I put under "Current USCIS Status"?

Part 2. (Application Type) - Which Box Do I Check?

Part 3. (Processing Information) - What do I put under "In what status did you last enter?". What do I put under the "nonimmigrant visa number", "consulate where visa was issued" and "date visa was issued"? the fradulent visa information?

Since we are filing this and know we are going to get denied, would it make sense to file the i-824 (for her daughter), i-693, i-864, i-765 and i-131 as well?

already have consultaed one, and I know which way I am going about things, just wanted to get some answers to the questions I have.

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

I have not seen one person on this board who entered on a fraudulent visa. I'm pretty sure YuandDan is right, and while KitKat1 is good with waivers, this is not addressing the waiver situation. These are questions you need to ask your lawyer, because as far as I and most other people on this board are concerned, your wife has no status and never had any status - but we could be wrong and are not going to give advice when it's a situation beyond the scope of this board.

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

Here are my guesses

Part ONE: I would answer "no status" or "no legal status", seeing as she is not here legally.

Part Two: I don't have the options available on hand, but If you are filing an I-130 concurrently, I believe that you would check "a" (at least that is what nost people do).

Part 3. I think you need to forget about using any information from the fraudulent visa. I would not put that number down seeing as the visa is not valid (seeing as it is fraudulent), so I would put - "entered with fraudulent visa" or "none" for the status part and for visa number/consulate put "none".

Removal of Conditions:

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Thanks for trying to help Jane, really apprieciate it. Actually, I got a PM from someone who is in a similar situation. If one of the moderators could close this thread... doesn't seem like any of the regulars have any useful information. When and if I get past the this bar, I will share it with the board so the scope can be broaden, thanks.
