Hi

I am just working on our I-864 and my husband (the US citizen) who is sponsoring me (the UK Citizen) and he does not have his original W2 from 2006.

He has his 2005, but I dont know what to do about the 2006 one?

His income shown on the tax return is more than sufficient for the poverty guidelines, but the papers say that you must include a copy of each and every W2....

Any help is appreciated.

Mrs. W

You can request for the IRS transcripts instead, you won't need the W2 at all.

Doesn't that take 30 days though?

Does anybody knw anything about these companies that say they can get your transcripts in 48 hours, for a $25 fee. I would pay it if they could do it???

So you just ordered it directly over the phone from the IRS, and it came back in 7 days. That's awesome. I will give that a try.

Thank you

I just wanted to add that it is for FREE. I should have not used the word "ordered" but rather "requested"

Your husband can request duplicate W2's from the employer too - it shouldn't take too long. We got RFE'd for W2's, so it's always better to include them, even though USCIS says they're optional.

Filed AOS from F-1
Green Card approved on 01/04/07

Just make sure it's sent to your current address - I told them to send to my new address and they sent it to my parents' house, delaying things.

Exactly. The Human Resources/Personnel department of his company should be able to provide him with another copy.

Yes, they should but USCIS doesn't say the W2's are optional. The options are full tax returns including W2's and 1099's or tax transcripts. There is no need for a W2 with a transcript.

The OP should not confuse duplicate tax returns with tax transcripts. Request the transcripts online (Google "tax transcript") or if you don't want to wait a week, just call them and ask them to fax them to you.

I received an RFE - or maybe I should call it "Request for Initial Evidence", in the mail yesterday. They are asking for W-2s, 1099s and/or all schedules submitted to the Internal Revenue Services. My husband is retired for so many years now and doesn't have W-2s. His retirement income is automatically credited on his bank account and we have bank statements to prove it. Will the bank statements will do in replacement of W-2s? He got 1099s attached to his yearly tax returns so I'm making copies of them. I sent all these documents along with our AOS packet that's why it kinda surprised me that they're asking for it. ;) Oh well... USCIS, what do I know?
