Hi Guys,

I just found your forum today.It is a wealth of information.

Lets hope someone has some advice and can help me out.

Here's my situation.

I am married happily to a US Citizen this past 3 years.All is going well but...

My conditional Green Card expired on 01/10/07 !!

And I just discovered this today.

The last time I looked at it (permanent resident card),was sometime last year and for some reason

I made a mental note that I needed to renew it in september 2007.

I realize now that I looked at the date 1/10/2007 and was thinking "euro format" at the time(that happens alot!)

and thought that the card expired October 1st 2007..

I am kicking myself for bring so stupid.

What do I do?

Is there any hope for me,as Im sure stupidity is not much of an excuse for being late?

I would involve a immigration lawyer at this point, and file the I-751, USCIS has been known to accept late filings, but they can also start deportation proceedings, this is why you may want to have a lawyer handy.

Submit the forms asap.... include a letter explaining how you were confused with the date of expiry... and thought that your card expired at the begining of October.... That is exactly what happened to friends of ours... USCIS accepted their form and they now have the 10 year card... but they did miss their date by only a few weeks...

:thumbs: That make very good sense, this will be understood. Jan 10 in the USA is 1/10 but in many countries like Europe, and I Know China 1/10 = October 1

One penalty you are paying is USCIS raised the fee this past July, if you had filed at the correct time you would have paid considerably less.

To the OP:

Not that lying is advised in general, but definitely do not lie to the state! Get those forms filled out and in the mail YESTERDAY. You may want to include an explanatory note directly before the I-751 in the packet apologizing, and explaining the circumstances. Don't delay any longer by wondering what you should do and such.

It wouldn't hurt to call a couple of immigration lawyers and explain the situation and get a quote as to how much it would cost for their assistance. However the more that you know (hey, you should know a lot now that you have access to information here @ VJ!), the easier it will be to explain your situation to a lawyer and probably the lesser fee they will charge you because you aren't coming to them saying "help I'm totally screwed with some immigration problems!" (read: debacle), rather you are saying "Help, I was a bit foolish and mixed up the date in filing my I-751 petition. I submitted it on X date with all of the requisite supporting documentation and an explanatory note describing and apologizing for the mix-up. Is there anything else that I can do that will help me remain on the path to LPR status?" (read:a simple question).

I'd certainly send it out BEFORE October 1. Otherwise your explanation with the date confusion wouldn't hold, as you would have obviously not even made your "assumed" deadline.
