Confused about the Police certificate

Timeline

I am receiving a lot of conflicting information about the police certificate requirements in India. In the Packet 4, it says that I need the police clearance certificates from both the district police station and the local area passport office. Then it says that only the passport office certificate is required if the passport has been issued within the past 6 months.

On other places, I have read that only the district police station certificate is required if the passport has been issued in the last 6 months.

My wife just had her passport issued in the past couple of weeks. She already has the police clearance certificate from the police station. However, she doesn't have the clearance from passport office. Will she needs to get the police certificate from both places or one of the places and which place would that be? And how long did it typically take to get the police clearance from the regional passport office. And help would be greatly appreciated.

FORM I-130 PROCESS

Jan. 15, 2007 - Got married in India

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

June 18, 2007- Sent completed I-864 package

June 22, 2007- Still no IV bill

June 25, 2007- Finally Received and Paid the IV bill!!

August 05, 2007- Sent DS-230

August 21, 2007- Case Completed at NVC

August 27, 2007- Case Forwarded to Embassy

October 15, 2007- Interview!! Visa approved!!

October 18, 2007- Visa in hand

October 27, 2007- US arrival!!

Here is what Department of State has on this.

Police Records

Indian Police Clearance Certificates should be obtained as follows:

  • All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office. These are usually more dependable than those obtained at a local level and indicate that the subject had no serious criminal convictions on record at the time of passport issuance. Applicants whose Indian passport was issued within the past six months may present just the Passport Office Police Certificate, and need not obtain additional police clearances.

  • Applicants over age 16, whose passports were issued more than six months previous to visa application, must also obtain a police clearance from the District Police Office serving the applicant's place of residence.

  • Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.

  • Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.

  • Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

So if passport is less than 6 month's old at the time of interview, the one from the passport office is all that is needed, if passport is older than 6 months, then you also need one from your district police office.

Thank you very much. This clears up the confusion that I had regarding the police certificates.

Here is what Department of State has on this.

Police Records

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

Dec 1, 2007 - Medical Exam .

I GOT IT

Jan 16 - I am in USA

April 15 2008 - Get my Drivers License.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

regardless, she needs the pc from passport office. That one is a must and unfortunately, that is the one you say you are missing. If you are going through New Delhi Embassy, I would strongly suggest that you email them any questions you have. No one at the Embassy is going to care what anyone here says. But if you have the reply from the Embassy for your question, then they will likely honor whatever they have said.

Thanks for the reply. My wife will not have this certificate by the time she submits the documents to VFS. But she will definitely have it by the interview date. Hopefully that will be fine with the embassy.

My wife has a new passport. However, she has already applied for the District PCC and the PCC from mumbai passport office. Something new I heard is - when you apply for PCC from mumbai passport office, they stamp the PCC on the passport. Is that correct?
