Timeline

I am the intending immigrant and also a sponsor. However just to be safe I am using a joint sponsor also when I file. Do I need to submit 2 I-864 forms, one for me and one for the joint sponsor? Because the I-864 already includes information about the intending immigrant, does that mean I only use one form for the joint sponsor?? I am confused...please help...

Typically an immigrant cannot self sponsor, their US Citizen spouse, US Citizen relative or US employer (Work Visa) sponsors them.

If you came to the USA on a K-Visa, your US Citizen Spouse will be primary sponsor, and if spouse's income is not enough, you spouse can use a Joint sponsor.

I am currently on H1-B here...I can use my income for sponsorship, because it says that in the forms...My wife is a student and she is the petitioner, however she is a student and doesn't have income...

Outside the scope of this board, it mainly handles family based immigrations, (IR-1, CR-1, K-1, K-3)

I think he's talking about a marriage based adjustment from H-1B. Preet, correct me if I'm wrong!

You won't be "self-sponsoring" - you will be including your own income to meet the poverty guideline. Your wife will be the sponsor even if she makes zero dollars. She will need to fill out I-864, parts 1 through 8, put "0" where it asks for income, and then you, on the same form, in part 6, will include your own income. If you wish to use a joint sponsor, that's fine - he/she will need to fill out another I-864.

So, there should be two I-864's altogether - your wife's with your info included in the "intending immigrant" section, and joint sponsor's.

Actually wife files I-864 as primary sponsor even with no income, and "intending immigrant " files I-864A contract between primary sponsor and himself as "Member of household" and the Primary can also use a Joint sponsor if needed, the joint sponsor needs to be US citizen and can use form I-864.

Who May Be Considered a "Household Member" for Purposes of This Form?
  • The intending immigrant, in certain circumstances. (See "How Can the Intending Immigrant Be Considered a Household Member"?)
How Can the Intending Immigrant Be Considered a Household Member?
  • The intending immigrant has the same principal residence as the sponsor and the intending immigrant can establish that his or her income will continue from the same source, even after acquisition of permanent residence.
  • The intending immigrant is the sponsor's spouse and the intending immigrant can show that his or her income will continue from the same source after acquisition of permanent residence.
