Hi all

Need ur advise what my husband prepared for his affidavit of support for me .he just working 6 months in a big store and his income pass the poverty level ,only he can't show tax return for the previous 3 years coz he stay in the philippines and he not file tax. and he have no income there, what we do?we still looking of a joint sponsor? the manila embassy accepted a willing sponsor even a close friends of him only?

His current job matters most. However, if you want to cover all your bases, any US citizen who is domiciled in the US can be a joint sponsor - it does not have to be a family member. A joint sponsor would need to meet the requirement for their household size plus you, and your husband could not combine income or assets with the joint sponsor.

About not filing because he has not been working for three years - he'll need to write a letter to include with the forms explaining why he does not have tax returns for the past years.

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

About not filing because he has not been working for three years - he'll need to write a letter to include with the forms explaining why he does not have tax returns for the past years.

Probably his current job and income if adequately documented will be sufficient. The statements about a joint sponsor are generally correct, but the Manila Consulate has some peculiar policies when it comes any sponsor but the petitioner. Often, we see reports they just don't accept them.

Very interesting about the joint sponsor thing in Manila. I didn't realise that the embassies could make separate decisions about that. Is this true just with the affidavits just for non-immigrant visas?

I've only heard this in connection to K visas, specifically K1 visas. An immigrant visa's I-864 is adjudicated by NVC, not the individual Consulate. (except for DCF cases)

This is in reply to your inquiry regarding co-sponsorships in K3

nonimmigrant visa cases.

Petitioners in K nonimmigrant visa cases are generally expected to

establish the adequacy of their own financial resources to ensure that

an alien, after admission into the United States, will not become

primarily dependent on the U.S. Government for subsistence. While our

immigration law does not disallow using a joint sponsor when the

petitioner cannot meet the minimum income requirement, co-sponsorships

in nonimmigrant visa cases are not legally bound to address the

financial needs of the applicant. The simple submission of Form I-134

by a co-sponsor is, therefore, not always sufficiently credible to

overcome the public charge provisions of Section 212(a)(4) of the INA.

In assessing the credibility of co-sponsorships, we look at the totality

of circumstances.

"Joint sponsor" and "co sponsor" mean the same thing.

I can confirm that the Manila embassy doesn't accept any affidavits of support for K visas. I was with my wife at her interview in 2004, and was shocked when the officer told me this. My wife and I just about fainted when he said that, but he ended up approving us even though I didn't even come close to the poverty line (I was still in college at that time). Even scarier, we were the first couple that was approved that day, and about 10 couples interviewed ahead of us. Manila is a tough, tough embassy...

Chance meeting in British Yahoo soccer chatroom. Totally random and unexpected...

Met in person in April 2003,visited several times...we used to think that people who met online were nerds...hehe.

Married in Makati, Philippines 9/22/03

Sent I130 to NSC 1/01/04

Received NOA1 1/04/04

Sent I129F to Chicago 1/11/04

Received NOA1 from MSC 2/5/04

Received letter from NVC stating we were approved and forwarded to Manila embassy...never got NOA2
