Timeline

Hello everyone. I have a question that I am not sure about? I have not adjusted my status yet and have been in the states now for 1 year. I came over with my kids on a Fiancee Visa and married within the 90 day time frame but we just havent had the extra money yet to change the status and myself and the 2 kids. I would like to take the kids home to Canada to see their Grandma but not sure if you can apply just for the travel parole documents separately or you have to apply for the AOS package which now includes the advanced parole already. I want to be able to take the kids back home for Christmas and dont want any trouble when it comes time to come back to the United States.

I have heard that you need to be living in the US for at least 2 years before you can travel outside.

Anyone with any info on this I would love to hear from you.

You cannot file for Advance Parole without first filing for your adjustment.

If you filed immediately you MIGHT have the document by December 25, but it's unlikely.

If you leave the US and try to re-enter without either an advance parole document or a greencard, you will be denied re-entry, whether you try to do so after two months, two years, or two decades.

Thanks so much for a quick response. It was what I thought it would be. Not able to file a separate advanced parole document.
