She already used her visa, but if you don't provide an affidavit of support for her to file AOS, she has to go home within 90 days of entry.

First sorry to hear about your situation

if your not already married I heard its as simple as putting her back on the plane cose since your not married there wont be a AOS to file , AOS is to file after your married

I would call the center and tell them about your plans just incase you have to deal with them in the far future again they will have it on file reason of cancelling the case good luck

Right. If you do not marry within 90 days, she must leave the USA. Those are the terms of the visa. The visa is dead already. Now she's on a 90 day clock. Her status is derived by the I-94 stapled in her passport. No marriage by the expiration date and home she goes.

If I were in your shoes I would feel betrayed and devastated. That being said, are you sure this is the end of your relationship? Some would say, of course it is! Yet others would say people in stressful situations, such as a life changing event like immigration, sometimes make mistakes like lapses in judgment. And even a fewer number might say, who care? let her have a wild fling with some old flame she is never going to see again when she leave her country.

My point is, you have a lot invested here. Is this something you can get past? Do you love her enough to build a life together regardless of the past? If she is indeed pregnant, can you be a parent to that child not of your loins? If you can not, then there is no shame in it. No one would expect you to. But if you can, then take the steps to put it back on track. Dont let emotion or public opinion make the ultimaten decision for you on this.

Yeah, right. If that were me, I wouldn't even put her on a plane. I'd just say "you're on your own".

You would not be alone. Many people are unable to get past an act of infidelity from their partner. I have witnessed good marriages fail from it and I have seen marriages recover. It is the fact that I have seen marriages recover that gives me hope for people like the OP.

Wow, that is a very difficult thing to hear. I have an acquaintance who was living in the RP for the past four years and just found out that his wife of most of that time has been keeping a Filipino in an apartment in their city using this fellow's money! Deception is bad medicine
