K-1 VISA VS WORKING VISA

Hi all..

We are recently enganged and about to start everything for the K1 visa. We found this site has been helpful for preparing our paper. We have some questions and hoping that may be some of the members could give us some advices. Regarding foreign fiancee, she has applied a working visa before and has been approved by NVC. The paper is stucked in the US embassy abroad for more than a year (waiting for the interview) due to the working visa retrogression. Would it create a problem for our I-129 petition? What shall we do with it? An other question is about the address of fiancee abroad. Is it going to be used for the mailing address by the embassy? Since the address (outside US ) isnt compatible enough for mailing address, is it possible to put PO BOX address in that address' box of G-325A?

Any advices will be greatly appreciated.

The address on your petition is two fold. It is used to direct the petition to the correct Consulate and Country and is also the address that the consulate will contact the person at. The address on the G-325 is used for FBI background checks (this is a normal processing step). No worries! Contact the embassy and see if they have a problem with using a PO Box on the Petition. The G-325a form should be their place of residence (a PO Box is not a residence ).

One thing you probably want to note is once the I-129F has been filed and processed your fiance may be looked at to have immigration intent. The consulate may be hesitant to issue ANY other visa other than the K-1 at that point because of the immigration intent (and your fiance can only then enter on the K-1 you are petitioning for).
