NEED HELP GETTING IN US AFTER DENIED ENTRY

Hello, i come here for help , i am desperate right now,i went tu the us on february 2005 on the visa waiver and stayed until march 2007 when i was only allowed to stay 90 days.i stayed because i got pregnant and the father and i ended up not getting married ,he was violent towards me and wouldnt let me our child with me if i was to leave the country.i finally was able to leave him in march and went back to france.i met my fiance then who is a us citizen leving in the us .i tried to come visit him last week and got denied entry for averstaying a visa waiver and sent back to france.me and my fiance want to apply for a fiancee visa but what are my chances? i have 2 us citizen kids,my daughter is having a hard time adjusting to france she doesnt speak french.what are the steps i need to follow and how long will it take for me to be able to get a visa? what should i say at the embassy when applying for a visa? will i be banned for 10 years ?please help me!!

You have a 10 year ban. A K visa will initially be denied based on the ban. Your fiance may or may not be able to overcome the ban with a hardship waiver.

Your fiance definitely needs to see a GOOD immigration lawyer.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Timeline

Two things, you were denied entry and have an overstay of more than a year. They are right that you have a ban for the overstay. This can be overcome only by your U.S. Citizen Spouse/Fiance filing the I-601 hardship waiver.

If you were Removed or Deported when you attempted to enter and were denied, then you will also have to file the I-212 with the I-601.

The best source of information on all of this is www.immigrate2us.net

There are tons of resources. If after reading all of them you do not feel confident enough to file the paperwork on your own, consult an attorney and they can file the forms for the two of you.

The hardship of the children doesn't have much to do with it at all, it is all the hardship to the fiance/spouse.
