step-child citizenship

Hello Everyone,

I am having trouble with how to get my Step-daughter her citizenship. I have a paper from guatemala saying that i am the father there and that i have all rights but the paper is also saying that she is my child by blood. Can i just apply for he citizenship based on the fact she is my child and sumit the paper from guatemala or do you think they will need more eviedence. Just confused on how a 6 year old gets citizenship thanks

Jeremy, is that paper you have an adoption paper?

I'm not sure which process is applicable to you but perhaps reading through this will help you.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

Since you are not listed on her BC as the biological father [are you?].

they may/will require DNA testing.

If you aren't then step children can acquire automatic US citizenship if adopted [after or before entering US] and they enter the US on IR2/IR4 visas.

If not IR2/IR4 they will still get USC if adopted when they are in your physical and legal custody for 2 years and have the GC.

You can then apply for a passport for them or file a N-600 for proof of USC.

I went for the PP.

Two different stories from USCIS on when the 2 year date starts.

One is from the date of final adoption decree and the other is your date of marriage.

The paper i signed is a reconocimiento it says I am the Father by blood my name is also on her Birth certificate and I am the signiture on her passport and all other papers.

After reading your previous post I reallydon't know what to think.

1)Does a 6 year old become a citizen on entree to the USA?

2)When i married my wife there was no father on the birth certificate or in my daughters life. After the weading I signed a book with a lawyer and my name was added to the birth certificate. does this count as an adoption?

Can't help you as I've no idea about how you would go about getting her USC other than a DNA test or adoption.
