Id deffinatly make sure his divorse was finalized.

Also make sure all forms were signed.

you werent denied, so dont stress about that.

unfortunatly the paperwork will prolly come back to your fiance, and sent again.

TO ME...and remember all we can do is speculate....it sounds to me like the problem was not with the fee, because that would be the first thing they saw before even cashing the check. If it was a fee issue, I doubt they'd issue a receipt number and then cash the check...the pkg as well as the payment...would be returned to you.

But again, keep in mind that it's pure speculation and none of us truly know what's what.

Don´t you think that if this was about his fiance´s divorce, they would just ask for evidence about his divorce???

If hes still married, and believe me they will know, then no, they will reject, an RFE is to show something that you may have forgotten to put in the packet, divorse papers bla bla. it dont take much to look up a finalized divorse. if they dont find one in the system, then they will reject

P.S.If we got valid case number,does it mean we have NOA1?

Is it possible for uscis accept the petition,give a case number and lately find out that they need correct fees and reject it?

I received a rejection notice in the mail due to supposed wrong fee and I still had a valid case number just like everyone else. They sent my application back and on USCIS website it said this

"On September 6, 2007, we determined that this I129F PETITION FOR FIANCE(E) was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case."

I got it back and it was because of the fee. I think there is a difference between a rejection notice and a denial. And I would think that they would send you an RFE before the actual denial especially if they had questions about your divorces or meetings.

Rejection could be because you didn't sign something or application was incomplete. Again, this is all speculation but I had the same message as you did and it was because our petition was "improperly filed." Also, this was dated September 6th and I did not receive mine until September 12th or so.

Did your fiance's address change and he might have not received the package??? You might need to call USCIS and find out what the notice said, tell them you didnt receive the package or the notice.

It sounds like they were sending the package back to your fiance. Has he received it back yet? If not, he will want to do a follow up with his congressman and see if they can track down when and where the package was mailed back. In the package it will say the exact reason why it was rejected. It could be something so simple as failing to sign the applications in the right places, or not including a number of documents that it was easier to reject rather than send send RFEs. Or, did your fiance include a US address at that time? You mentioned you were living together up until June when the application was submitted. Was he out of the US at the time? If he didn't have a US address that could also be a reason for its rejection.

So, the important thing is - has your fiance received back the rejected application form? If he has, what does it say is the reason for rejection. If not, has he moved or has the return address changed?

No they did not cash my money order although they did stamp it. They sent the whole package back including the money order, and thats why I was speculating if there was paperwork missing with your package or signatures etc. Also you filed WAY before I did and weren't cutting too close so it probably wasn't a fee issue.

Yes,my fiance was out of country for a past year..He was currently stationed in South Korea and by June 2007 he had to go back to the states and report in Fort Hood,TX.

No,he didnt get a package yet..Tomorrow will check his mail-room again..

Also,Senator sent him email and ask him to contact his office,tomorrow my fiance will do that..

P.S.I dont think that here's issues about still being married..

I dont think that if a man still married he will anyway file the petition for fiancee,pay for that,etc..

Sounds a document problem, if check was cashed it is not that. Cant really speculate as to why, something in the docs was wrong, ommitted or a combination of both

Am quite sure Gimli fancies me. So unfair. He is waist height, so can see advantages there, but chunky braids and big helmet most off-putting. Foresee dark times ahead, very dark times.

Our petition is not denied and the notice on the USCIS website had said that it is rejected. So, we need to wait for our letter or package and supply what is needed by USCIS to get our visa back on track.

It is a delay and not a denial.

"Remember, just because you're applying for a K-1 visa does not necessarily mean you'll get it. USCIS can reject applications for a number of reasons. You'll up your chances of landing the visa if your bride-to-be is free of any criminal or other questionable background. K-1 visas will almost always be denied to applicants with any one of the following: a communicable disease, a dangerous physical/mental disorder, a drug addiction, or a criminal record (including moral turpitude, drug trafficking, or prostitution). Your fiancee's visa may also be rejected if she is deemed likely to become a public charge, has entered the U.S. illegally, or is otherwise ineligible for U.S. citizenship."

So barring from the above, it could be as simple as a check not being signed when mailed. How many of us have done this when paying bills *raises hand*! You will not know for sure until you receive notice from them. However, you can call them and may be lucky enough to get that customer service rep that will give you some info. Have the petitioner call the 1800 number and follow the prompts. In our case where it took so long for a touch I hit the prompt relative to VSC requesting more evidence that I did not understand, having no idea at that point that we were getting an RFE. This prompt brings you the center that your case is in and a real person that does not sound like they are rehearsing for a sitcom. However, keep in mind that not all of the reps will give you information or sadly the correct information, but it is worth the try. When it comes to the people that we love everything is worth the try.

A rejection notice and a denial are not the same thing. As most of us know and RFE is a Request for Further Evidence during the process between NOA1 and NOA2. The USCIS website (profile) will reflect this to include the date the RFE was sent. But never for what it was sent for.

Where the word "rejection" is being used and not "denial", my guess is if you have no issues as stated in the above, it could be the packet is not complete. When you get your first receipt number it is my understanding that they are acknowledging they have received the packet. They then have to go through the packet which brings you to the NOA2 if all is in order.

Also, you mentioned that your fiance (petitioner) has just recently divorced (if I read that right...early only one cup of coffee), keep in mind that most states have a waiting period of 30 plus days before they can remarry (Appeal Period). So if you had filed before the end of that period that could also be the problem.

But at the end of the day we could all guess what it could be (been there done that with an RFE), as hard as it is...it is a waiting game until you have what you need in hand.

But, I would still call.
