I checked uscis website and found out that our case status is rejected..

Receipt Number: EAC07232****

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status: Case Rejected

On August 13, 2007, we determined that this I129F PETITION FOR FIANCE(E) was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case.

My fiance didnt get any notice yet..

Can somebody tell me is it RFE or they denaed our petition..

Oct.02 2007 I129F sent to VSC via ups.

Oct.25 2007 NOA1 receipt .

March 04 2008 Approval notice sent .

April 8 2008Interview . APPROVED

April 11 2008Visa in hand

April 27 2008POE - JFK

April 30 2008 WE GOT MARRIED!

July 3 2008 My sweet husband left for Afghanistan

Sounds like some error in filing is not RFE fixable. Everyone could theorize what it might be. Your fiance is the USC? and has the same address as when he filed?

You need to focus on getting whatever the notice of denial and how to fix right now.

Hope it works out quickly!! This is a tough road for many of us for many reasons.

If it were RFE, the online status would say so--I've looked at cases that were reported that way on the USCIS site. When your fiance receives he rejected case it will, as the notice says, contain the reason(s).

you don't have a timeline, so I can't check dates properly, but if it was filed around the time of the fee increase (as the mentioned date of August 13 would seem to indicate) it may well be it was received after the July 30 cut-off, and has been rejected due to incorrect fees... do you know how much your cheque / money-order was made out for? if your petition was post-marked (or, as some have found to their cost, received) after July 30 you'd have had to pay $455, not $170 as it was before

Day One: Went to Council of Elrond. Was prettiest person there. Agreed to follow some tiny little man to Mordor to throw ring into volcano. Very important mission - gold ring so tacky.

Day Six: Far too dark in Mines of Moria to brush hair properly. Am very afraid I am developing a tangle.

Orcs so silly.

Still the prettiest.

Day 35: Boromir dead. Very messy death, most unnecessary. Did get kissed by Aragorn as he expired. Does a guy have to get shot full of arrows around here to get any action? Boromir definitely not prettier than me. Cannot understand it. Am feeling a pout coming on.

Frodo off to Mordor with Sam. Tiny little men caring about each other, rather cute really.

Am quite sure Gimli fancies me. So unfair. He is waist height, so can see advantages there, but chunky braids and big helmet most off-putting. Foresee dark times ahead, very dark times.

He sent it on June30 to TSC and included 170$ check..

Check been cashed on 18 of July..

We didnt get NOA1 hard copy and we couldnt find out about case number(copy of cashed check wasnt clear)..

My fiance asked Senator for the help and Senator found out our case number..

Today I sing in uscis website and found about our case being rejected..

We dont even know our NOA1 date,last update in uscis wensite is 08/14/2007

P.S.If our petition been rejected because of the fees,why then they gave us a valid case number?

I thought once they cash the money,they give the case numbers..

Dunno what to think..

yeah, that's odd... I thought, like you, that if they cashed your cheque then the basics were right; you might still get an RFE but the thing was at least 'in the system'... I don't know; I got no more theories :wacko:

unless it's that the wrong thing was posted on the website; THAT would be good, if it was just an error

One of you isn't divorced or submitted insufficient paperwork to prove a divorce is final.

You haven't seen each other in person during the past two years or insufficient evidence you of meeting.

Do either of those sound like possibilities?

We met in September 2006 in Korea and untill June 2007 were living together.

At the end of June we filed the petition.We know each other for a year and I didnt see my fiance just for about 4 months.

Yes,I've been married in Korea and we added my korean divorce paper to petition,but didn't add divorce paper from my home country-Uzbekistan.

We just went to Uzb.embassy in Seoul and took paper that saying that I am free and clear to get married.But later,when I got back to Uzbekistan,I sent via fedex my uzbekistan divorce degree to my fiance.

Also,I my fiance just got divorce at the end of June and we filed petition straight after that.

I don't understand.If uscis immigration officers found out that me or my fiance is still married ,they would denie petition,but not just reject it.

P.S.If we got valid case number,does it mean we have NOA1?

Is it possible for uscis accept the petition,give a case number and lately find out that they need correct fees and reject it?

P.S.S.I appreciate all answers and thank everybody who's willing to help!

Is it possible for uscis accept the petition,give a case number and lately find out that they need correct fees and reject it?

I received a rejection notice in the mail due to supposed wrong fee and I still had a valid case number just like everyone else. They sent my application back and on USCIS website it said this

"On September 6, 2007, we determined that this I129F PETITION FOR FIANCE(E) was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case."

I got it back and it was because of the fee. I think there is a difference between a rejection notice and a denial. And I would think that they would send you an RFE before the actual denial especially if they had questions about your divorces or meetings.

Rejection could be because you didn't sign something or application was incomplete. Again, this is all speculation but I had the same message as you did and it was because our petition was "improperly filed." Also, this was dated September 6th and I did not receive mine until September 12th or so.

Did your fiance's address change and he might have not received the package??? You might need to call USCIS and find out what the notice said, tell them you didnt receive the package or the notice.

09-14-2007: Letter to congressman with copy of postmarked envelope asking for help with appealing rejection

09-20-2007: Reply from Congressman to send it back with old fee and copy of post-mark. Package sent again directly to VSC

09-24-2007: USPS delivered package to VSC at 2:32 PM

I believe his divorce was finalized,he said so..

I think he did send copies..

Hey, as far as I´m concerned, when you get denied, you get a receipt notice on the mail saying your case has been denied and they explain you why and how to appeal...But you say that it also shows on the website that say rejected....it doesn´t look like a denial.....and I never read before that they send you back your paperwork when you get denied.....

Just move fast! You know how long this process is....

Rejected means the pkg was rejected.

TO ME...and remember all we can do is speculate....it sounds to me like the problem was not with the fee, because that would be the first thing they saw before even cashing the check. If it was a fee issue, I doubt they'd issue a receipt number and then cash the check...the pkg as well as the payment...would be returned to you.

But again, keep in mind that it's pure speculation and none of us truly know what's what.
