Hi Everybody ! I have a question , i want my 10 year old son to come to the US , ok let me start from the beginning i have two kids ( boy's ) in the age of 10 and 12 , the 12 year old is with me over here in the US and the 10 year old is living in germany with his father , he wanted to live with his father before i filed the I-129 and before it was planed that i will move to the US , i wasn't very happy about that because me and his father never got along he was always fighting for the whole costudy on his side but we have 50-50 and he could never change that , before i left to the US i asked his father to make my son a passport and let him atleast visit me and his older brother , his

father said yes he will do that but i knew already that would never happen , when i saw my 10 year old the last time which is now 1 year ago he wanted to come with me and he was crying and said he don't want to live with daddy no more , the problem is i could not do anything cause his father won't let him go , and since he have 50% costudy i need his agreement to take my son over here and he would never agree to that :angry: now my question is there anything i can do from here to get my son living with me ? somebody maybe had or have the situation ? :help:

I'm sorry to hear of your situation.

Unfortunately, if your ex-husband has joint custody of your son, and refuses to give his permission for you to bring him to the U.S. to live, I doubt there is anything you will be able to do. I know in Canada, there is an age where the child can decide which parent they would like to live with. I think that age is 11, but I'm not positive. Maybe Germany has a similar rule.

I know how much I miss my 2 sons that live in Canada, and they are not children, they are adults. I get to see them whenever I want, though, because we only live 3 1/2 hours from them. But, for you, it must be very hard not to see your son who is still a child.

I hope you can resolve this situation to the point where, even if your son cannot move to the U.S. to live with you permanently, you can at least have him come to the U.S. for occasional visits.

Thanks raymaga for the quick replay , i thought so there is not much i can do , but yes you right Germany have similar rules that children can decide with which parent they want to live with i think the age was 12 , i will get me some more info on that . Yes it is very hard not to see my child , before i could see him often cause his father lived very close to me and my son could come when ever he felt like to my house now all whats left is telephone calls if his father allow me to talk to him and if so the the speaker is always on so he can hear what i have to say , well lets hope that when he is 12 that we can do something about this situation thank god he will turn 11 this november so there is one more year to go .
