A few days after my husband and I were married, we went to my local Social Security office, and applied for his Social Security Card. We were told that he could not apply for a number unless he had a valid reason that he was using the number for something other than obtaining employment.

We were later informed about the RM 00203.500 form.

Last week, he got his one year EAD card in the mail, and we went back to re-apply for his SSN. They told us, that they have to send copies of his passport, his I-94, and his EAD card to the Department of Homeland Security because his I-94 is expired, and his visa is expired. (Duh, we knew this) We filed our adjustment of status documents after we were married. (Obviously or he would not have gotten his work authorization.

The Social Security office told us that they would call us when they found out something from Homeland Security.

What do we do now? Can he even get a SSN because that office neglected to tell us that he could have had one when we came in and applied the first time? (It just would have been stamped that he was not allowed to work)

I'm afraid that it's going to be some long drawn out process now...or we will be questioned for not doing the process properly.

I'm upset. :help:

The Social Security office told us that they would call us when they found out something from Homeland Security.

What do we do now? Can he even get a SSN because that office neglected to tell us that he could have had one when we came in and applied the first time? (It just would have been stamped that he was not allowed to work)

I'm afraid that it's going to be some long drawn out process now...or we will be questioned for not doing the process properly.

there is nothing more to do now...you wait to hear from SSA

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

It's possible that your husband's EAD is not yet in the SAVE system which SSA uses to verify an immigrant's status. Go back in two weeks and see if SSA has received the verification from USCIS. If not, ask them to send a manual verification.

That's BS. The SSA office doesn't have to automaticlly send copies of his EAD card to DHS. His I-94 being expired has no baring on this he's got a valid EAD card. The SSA office is supposed to do an initial verification request and then a secondary electronic request, Then if that comes back that they want to see the documents, the G-845 is sent with copies of the documents to DHS. I would go back and see if the secondary electronic request was made and was the response to that to send copies of the documents. Start yelling for the office manager if the service rep jerks you around.

BTW Which SSA office was this?

The SSA office is supposed to do an initial verification request and then a secondary electronic request, Then if that comes back that they want to see the documents, the G-845 is sent with copies of the documents to DHS. I would go back and see if the secondary electronic request was made and was the response to that to send copies of the documents. Start yelling for the office manager if the service rep jerks you around.

The one in Forrest City Arkansas. My husband says that they probably don't have a lot of experience with this, because they don't get a lot of immigrants around here. So, they don't know what they're doing. Maybe when they call DHS, they will tell them how to do their job and get his SSN Card.

I'm just worried that his papers will be sitting on someone's desk for God knows how long...and he's really anxious to start working.

That's no excuse. They should be made to do their job correctly.

When we applied my Husband did not even have to show his I-94. All we took was his passport ( we had taken out the I-94 ) and EAD, they gave us a letter stating it could take 6-8 weeks, however we recieved the card within 14 days in the mail. If in 2 weeks the card has not arrived go back to them and ask what is going on. The out of status has no bearing as he has been granted permission to work in the US while awaiting his AOS. See my timeline my husband had been out of status since 2001.

Why is it that the only one who can stop the crying is the one who started it in the first place?

Exactly. My husband was telling me that earlier. Cool to see someone else that's going to the Memphis office, and a Rush fan to boot! :thumbs:
