Married name or name as listed in Passport for I-864

Timeline

I have a little dilema, I used my last name for my wife for filling out I129 and I130. Now I am trying to fill out the I-864 (affidavit of Support).

My question is should I continue using my last name for my wife too or should I use her maiden name as listed on her Passport (issued before marriage) and our marriage certificate?

We used married name for AOS, and applying for SSN, this way the SSN and Green-Card have married name. If you use maiden name, and later decide to change the green card, plan on paying a fee to file the I-90 for the name change.

Thanks in advance.

Your wife's current legal name should be used on all documents at all times. If her name has changed legally, she'll need a passport that reflects that name. Her visa will only be issued in the same name as the passport in which it is affixed.

The I-864 is not needed until AOS. For the K3 visa, the I-134 is used.

Your wife's current legal name should be used on all documents at all times. If her name has changed legally, she'll need a passport that reflects that name. Her visa will only be issued in the same name as the passport in which it is affixed.

I have been using my last name as her last name since our marriage in all my applications, but there is no official name change process that we went through besides the marriage. Her passport is issued before marriage so it got her maiden name.

It think it is virtually automatic in India but wait for somebody with direct experience to confirm. If so, she needs a new passport with the correct name.

These are things you need to know, not assume.

I contacted Chennai Embassy and their response is, it's not a problem to apply for K3 using married name but the Visa will be issued as per the name in the passport. But now to do the Affidivit of Support I am confused about which name to use.

In both I129 and I130 they ask for Maiden Name so I wasn't worried but in the I-134 there is no maiden name column so now I really gotto choose between going with married name or Passport name. I think I am going to fill two applications and send them both to my wife, the consulate can just use which ever they want.

You would be wiser to get her a new passport with her current legal name. I don't understand the confusion. Asking her maiden name is not the same as requesting that you use it as her name. They just want to know her maiden name.
