My petition is still at Casa. I called Joe Noell in the Executive Office, told him about my fiance's interview, start to finish,

thinking he might could keep it from going somewhere. HA!!!!! He said Kim is no longer there as an interviewer. But the one he had was very efficient in her job and something just did not click with her so she does not believe our relationship is real. I cried a little, didn't help :crying::crying::devil: !!!!!!!!!!! He says they see a lot of fraud cases come through there and they have to be careful. I told him he had all proof needed to show it was valid relationship and that she did not want to see it.

Just something happened I have no idea what, to give 221G. Now he did say it is not really a denial, but to wait until USCIS has it in hand. If I have to appeal, it will cost $585.00. OH BOY!!!!!!!!!!!!! They must think we are made out of money for all this.

All I want is him to come here :angry: and they don't believe him but me :blink::wacko: .

So now tell me someone what is a CR 1? I heard that was faster than a K3 if I decide to go get married over there.

It is better to sort out the 221g and get the K1 visa than it is to give up now, get married, and try for a spousal visa. You will run into the same problems, or worse problems, if you do that. Get some advice here and/or from a lawyer how to file the appeal and do it as quickly as you are able to.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

It would help if you were more clear in what type of visa you have attempted to get so far. I assume you are the USC.

Appeal is not only expensive but can take one year is my understanding. I made mistake in my 129F & found that I could ask for Motion to re-open for free. I did so. It took 2 months for that to occur & one day to finish the case after that because I sent the corrected info to them with the motion.

I tried 3 times to get simple tourist visa for my wife & was denied each time. They are as you say very careful about issuing them due to the incredible amount of fraud. In my last attempt the Embassy officer said " even though I believe everything you have told me & your documents are perfect I can not issue visa without being fired for doing so" . Amazing. The problem is meeting the "strongest ties" criteria. They feel that when he enters the USA you will file for adjustment of status & he will not return to his country.

K1 may be the fastest if your intention is to marry in USA. Check timelines on V J .

They inspired me to seek CR 1 visa & we have been approved after a long wait. Now awaiting NVC to assign case number. Our 129F is also approved & we wait for NVC on that one as well.

Contrary to what it says in the timelines about NVC case number ect NVC just told me(9/20/07) to expect at least 90 days just to get NVC case number.

Take the time to look at V J Forum area. There is a lot of good info there for you I think. I have found V J to be excellent source of info & the timelines found here are accurate in most areas.

K3 is result of 129F. CR 1 is result of 130. In every case you must file 130 anyway. K3 can be approved faster but in my case it was not . K3 requires a 134 form at one point where the CR1 requires 864 to be filed later with NVC.

Basic difference is procedure following each as to NVC action. K3 doesnt require as much time with NVC but you still need case number from them.
