I am a Canadian currently in South Korea with my American husband and our newborn child(American-Canadian).

I had my IV interview in June, but was declined b/c the criminal check I provided was not from the RCMP but from my local city police department in Ontario. Apparently being an embassy abroad they have the right to request an RCMP check!

I had to mail in fingerprints from Korea to the RCMP in Ottawa to get this check done. My problem is that my husband and I are due to leave Korea in 2 weeks(US military orders) and I have not gotten this check back from Ottawa(takes a minimum of 4 mths)....and so it is looking like my IV cannot be completed here.

Seoul is telling me to just transfer the case to Montreal now...and Montreal tells me that first it will go to NVIC and then to Montreal and that it will delay everything by 6-9 months! I cannot stay in Korea any longer either to wait this out.

Are there any other options available to me? Can I enter the US as a tourist and arrange some paperwork from there?

Please help! So stressed out about this. I am waiting till the very last day in the hopes that this criminal check will arrive! :crying:

It's a tough situation and relatively unique. Usually at least one Canadian a day asks about entering the US to visit their spouse during the process, so you'll find plenty of information on that in any of spouse or fiance visa forums. It sounds like you'll be choosing to transfer the case to Montreal or flying back to Seoul in a few months.

I don't know much, but I do know NVC does schedule the CR-1/IR-1 interviews for Montreal. Not sure how it works when they transfer a case from consulate to consulate. Montreal seems to be a very slow consulate when it does come to handing out appts, that goes for the k1 and k3 visas as well. Best of luck

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Wait...you mean...they DO schedule interviews for CR1/IR1 folks at Montreal??? :devil:

NVC: 07/20/2007-11/08/2007

Interview at Montreal Consulate: 01/18/2008

(2 months' additional security checks)

Received Green Card: 05/12/2008

I think that is still up for discussion! :)

Anyway burnsis, have you contacted them by email to see what the status of your application is? On their site they have this:

Q: How can I verify the status of my application?

A: Contact us by e-mail and provide the following information: civilnps@rcmp-grc.gc.ca

Your full name and date of birth

The date and the reason you sent the application

Whether the processing fee was included (if applicable)

If not I would recommend that you do. I also don't think it would hurt to explain your situation to them, maybe they will expedite it even though they say they don't expedite.
