We are filling out the forms for AOS and it states that you need to provide 3 tax returns for the I-864 form but i read somewhere that only one is required now. First of is this true and if so do you just fill out the form and use the one tax return ??

Yes, it's true. There was an interoffice memorandum last November about that topic, saying:

"This memorandum notifies adjudicators that USCIS has determined, as permitted by section ...... of the Immigration and Nationality Act (Act), that a person completing an Affidavit of Support (Form I-864) on behalf of an adjustment of status applicant is only required to file one Federal income tax return, for the tax year that is most recent as of the date the Form I-864 was signed, rather than having to submit a Federal income tax return for each of the three most recent tax years ."

11/20/06 USCIS cust.service started inquiry about case (because it's outside of processing times)

12/07/06 Greencard in the mail (= 8 months and 21 days for the entire AOS process)

That might be the case, but I would still suggest that you submit all 3 seeing how some peple received RFEs for tax returns.

February 1, 2006 - Married in Brooklyn, NY

February 7, 2006 - I-485, I-130, I-131, I-765 Filed

February 18, 2006 - NOA for I-485, I-130, I-131, I-765

March 16, 2006 - Biometrics for I-765, I-485

March 16, 2006 - I-131, I-130 touched

March 18, 2006 - I-765, I-485 touched

March 18, 2006 - RFE for I-485

March 20, 2006 - I-485 touched

March 27, 2006 - RFE sent out

March 31, 2006 - USCIS received the RFE

April 3, 2006 - I-485 touched

April 5, 2006 - I-485 touched

April 6, 2006 - I-485 touched

April 19, 2006 - AP approved

April 24, 2006 - AP received in the mail

April 22, 2006 - EAD touched

April 24, 2006 - EAD approved

April 29, 2006 - EAD received in the mail

May 15, 2006 - Interview letter received

July 12, 2006 - Interview

July 12, 2006 - APPROVED!!!!

August 14, 2006 - Welcome to the US letter and I-130 approval received in the mail

August 15, 2006 - Permanent Resident Card received in the mail

"Therefore, for any Form I-485 filed on or after the date of this memorandum, the sponsor shall not be required to file any Federal income tax return for any year other than the tax year immediately preceding the sponsor’s signing of the Form I-864. For example, if the sponsor signed the Form I-864 after April 15, 2005, only the sponsor’s 2004 Federal income tax return would be required. However, the sponsor may file the three most recent returns if the sponsor believes that the additional returns will make it more likely that the Form I-864 will be found to be sufficient. This rule shall apply to petitioning sponsors, as well as substitute or joint sponsors signing a Form I-864 for an adjustment case."

Thanks for the info much appreciated.

I think we will just submit the one right now and also include a copy of the memo just incase the officer has any issues when they view it :D.

hey sweet wedding announcement website. Where did you guys get that & mind if i ask how much? soooo sweet! :D

Thanks for the compliments. I actually designed the site for us. Its something i do in my free time so it cost me a few hours of my time. I create random things to learn new tricks and doing this site for our wedding was one of them :) but i know some people charge a fortune for that kind of thing.
