is the joint tax return a big deal? due to our circumstances, we didn't file this together. my husband was in deployment at that time (he is up to now) and it takes weeks to send packages. so we decided to just file separately coz we didn't think that it's gonna be a big deal. also, i live with my parents so we don't have any lease or whatsoever. but my parents can atest to that.

we do have joint bank statement, even a lot of statements with overdrawn amounts, notice from collectors addressed to my husband, and two bills under our separate names. i also have his insurance and paystubs that indicates me as his dependent. i have retirement plan with him as beneficiary. we have car title and car reg card under both of our names.

do you think i have enough? also, i dont knwo what date we should put beside his name, because he signed the form before he went overseas, which is 1month early. i'm also planning to include a copy of his deployment order, since i answered yes to question #10 on the second page.

I hope someone with more extensive knowledge on the military filing issue can chime in and give more solid advise.

This is what I believe to be true - but you might want to double check it.

As far as I know soldiers deployed to a warzone are exempt from tax filing until some time after they return (at least this had been the case with my husband in 03/04). Therefor it makes complete sense that you wasn't able to file together and USCIS should be aware of it.

However, keep in mind that you should provide evidence covering the time from your marriage to today. So this would mean at least 2, eventually 3 tax periods. Do you have joint tax return for another year? if so provide this, and attach an explanation as to why you didn't file jointly for last year.

As for the evidences you've listed. Of course you can only provide what you have. Just look in the visa faq and guides on this site and read posts on what others have provided. May-be you will get some more ideas of what you can add to your list. Anyway, no-one can tell you if whatever you file with I751 will be enough or not.

As for the signature date - I personally would put the date he actually signed it.

You write that you currently live with your family. Did you move back to your home country? This might have implications on your filing procedure/status.

we can only have 2 tax return up this date. we did not file the first year and also for this year. but we are planning to do it next year.

i did not return to my home country. i'm still here in the states.

i hope that you will continue in giving me advices as i'm really panicking! i'm carrying this burden alone right now, my husband just left for iraq yesterday.

I think if you study the guide for removing conditions you will feel much more secure about the process. The guide here on VJ is outstanding :thumbs:

Regarding tax transcripts, not everyone file jointly. However, even if you file separately, you still indicate on there that your status is married but filing separately. Still include your tax transcripts and if your husband filed also, then include his too.

I can do that. I'm not sure if I can include his, if it gets here on time I think I can (it takes about. I payed about $1500 for filing separately instead of jointly. :) Uhm .... I also have 3 affidavits and some photos, even some receipts that goes to his FPO address, and a priority overnight package for laptop before his deployment, dependency application to the navy, and his deployment orders (as requested on part3 #10).

i hope they wont give us a hard time, just like what they did before. for my AOS application, they interview us together, lasted only about 20min, not too many questions asked, and I think they interviewed us in a different room and floor (4th flr, for orange county,ca residents in their santa ana office). ***sigh*** i just cant wait 'til its over.
