August / September I-130 2007 Filers

Hi everyone

I m an Indian Citizen and my husband is a US citizen

We got married in August 2007 in India

My husband has filed all the paper work needed for wife immigrant visa and he got NOA-1 with my new last name (his last name) but I have a valid passport with my old name as single will that be a problem for issuing the visa?

Question – 1:- Is it necessary that PASSPORT MUST MATCH EXACTLY WITH THE NAME ON THE VISA?

Question - 2:- Do I have to make a fresh passport with my new last name and marital status?

Please reply at the earliest

Omshantiom, I can't answer that question. But if you have time, you should change it because we know there would be no problem if your passport had your new last name. If your husband just got his NOA1, then I'd guess you have 6-8 months before your interview at least. If you can renew your passport within this time, why would you not want to? I know that doesn't answer your question and I'm sure you've had the same thoughts. But I didn't want to leave your post hanging in the middle of a dispute that I started. Maybe someone more senior or experienced can give you a more detailed answer.

i have the same situation.. go to the passport agency close to you in india with your marriage certificate and birth certificate and they will change the name for you, tell them you want to apply for a new one ... now it only take less that a week to get a new passport in india.

in my case i used my wifes maiden name and she just had to endorse that i am her husband in the passport with is a seal and my name and 1st magistrates signature

If you back out of the maze far enough you'll realize we are in an IR-1/CR-1 Immigrant Visa forum as we speak...err..type! Your K-3 non-immigrant visa discussion is located one forum above our current location. :) So by default, any thread that is labeled I-130 (or any thread for that matter) within this forum is assumed to be the immigrant visa or the IR/CR visas and not the K-3 non-immigrant visa forum. I am quite aware, as you request, of the mulitple forms K-3 filers complete. I almost went that route. Sky - just keep going mate, as there are alot of us appreciating what you are doing - also with Sunshine and Delicia timelines - it makes us a group of just wanting to contribute - correct me if I am wrong, but that I do not find confusing in the least. Whether we are July August September October November so forth, does not matter, the effort is appreciated. I spent three hours on the phone last night with a VJ who is further down the road and so informed, yet he is dumbfounded by some things that are going on. All we can do is support each other - we all have A COMMON GOAL - and that is having our SO's next to us soon.

WaitingForK3, no one told Sky to stop helping other folks here. This is the confusion I referenced susieK about. I'm glad to see that your comment is based on what she said rather than on anything I ever said. It also backs up my point that susieK (great attitude and all) misunderstood my words and purpose. I never told sky to stop helping other folks.

I'll say it again. I just think that K-3 visa petitioners should discuss their I-129F's in the K-3 forum. That's all I said. But I get a lot of flak for making the statement and then in order to justify words and actions, people start twisting the debate off the original issue. Perfectly done. Now I look like the bad guy who is trying to tell Sky to stop his quite extensive work. But I did no such thing. I can even praise Sky in previous post's and still my misson (to get K-3's in the K-3 forum) goes unnoticed.

Seems like out of all the commentators, Sky was the only one who understood what I was saying. He disagreed...and has the right to do so...but he didn't take the emotional tangent and change subjects...he stuck to the issue. I can't really say the same for the rest of you. :)

Oh well, I had fun trying anyway. And I don't think anyone got too hurt.

Did not misunderstand you for the thread is for August September I-130's with some of us having an I-129f attached with it- and that is what we are - I only corrected Sky with one person - that is helping and not emotional tangent and we are not changing subjects, we are trying to stay on subject here FOR AUGUST SEPTEMBER FILERS.

Good Luck to you and the cheers were long before you post to Sky for helping on a timeframe since alot of us have been here for quite awhile and await each and everyones NOA1 - different animal then it use to be, but for us that has been a big deal.

Ok this is a 130 yes but if you look the k3 is attached to 130s so k3 is also a issue here as well but as you seem to think in only mono then please open other threads to deal with this issue but as some of us can clearly think outside the main issue then please leave us to openly help each other thank you

Ok this is a 130 yes but if you look the k3 is attached to 130s so k3 is also a issue here as well but as you seem to think in only mono then please open other threads to deal with this issue but as some of us can clearly think outside the main issue then please leave us to openly help each other thank you

You know what, you're right, the K-3 (I-129F) is attached to the I-130. That's what makes it the K-3! This is not the K-3 forum. Nor is it the I-130 forum.......This is the IR/CR forum...hehehe, you guys are really silly.

The K-3 visa only become the K-3 visa when you include the I-129F to the I-130. Of course the underlying visa is the CR/IR.....but when you file the I-129F on top of the I-130, you begin a new process that is known as the K-3. It is a branch off of the main tree of the CR/IR that has become big enough to merit it's own forum...at least the creators of VisaJourney.com thought so.

But at this point, you will never agree with me....of course, I knew that about 5 posts ago. But I will continue to say the same thing....I'll just try to put it in different words until we can all become one again and begin to speak bad about USCIS in harmony :)

Ok, this is last post unless prompted. :) How likely is that? hehehe . You ask why I come to this thread since I am a December filer. That's a good question since I'm not an Aug/Sept filer. The reason I come to the CR/IR I-130 Aug/Sept 2007 forum/thread is because I'm looking within the CR/IR forum how things are progressing for SIMILAR (IR/CR) filers as myself. Obviously you understand why. I can judge and predict only on similar visa filers. If things are moving for I-130 filers (not K-3) then things are moving closer to my date. But the Aug/Sept thread is becoming inundated with K-3 or I-129F discussions...no, it's not the end of the world! But, in my opinion, there is a different forum created for those discussion based on K-3. Thats why I visit the Aug/Sept thread. Why do K-3's visit the IR/CR Aug/Sept thread and post their progess?....I filed...I'm approved....These posts should remain in the K-3 forum.

I understand the very close relationship the two visas have. And it's that closeness that creates this subtle problem. But it's clear that under normal conditions, any post expressing the filing, the approval or the tracking of such I-129F should, by inherent structure of the visajourney, be posted in the K-3 forum.

I'm tired :) And in a very real sense, I do feel as if I'm helping all members of VJ too....just cleaning out some corners or bringing to light obscure problems that seem to be ####### on the surface but really help maintain more order and control....which in the end, will help people find what they are looking for. But no one likes being told what to do!

I do understand what you are saying James. The thing is that we all(atleast me) have made friends here mainly from this form. Everyone stuck by with one another(HOHOHO, SusieK, myself and whole lot of other peeps) during hard time and now people look upto this form for sharing any sort of issues and concerns(which is not a bad thing at all in my opinion since its all about helping fellow VJs.) hence you see K3, CR1 etc all posting here. No harm done, its all cool..

I'm tired :) And in a very real sense, I do feel as if I'm helping all members of VJ too....just cleaning out some corners or bringing to light obscure problems that seem to be ####### on the surface but really help maintain more order and control....which in the end, will help people find what they are looking for. But no one likes being told what to do!

I do understand what you are saying James. The thing is that we all(atleast me) have made friends here mainly from this form. Everyone stuck by with one another(HOHOHO, SusieK, myself and whole lot of other peeps) during hard time and now people look upto this form for sharing any sort of issues and concerns(which is not a bad thing at all in my opinion since its all about helping fellow VJs.) hence you see K3, CR1 etc all posting here. No harm done, its all cool..

Aye...agree K3, and most of us only have an I-130 anyways so ya learn every day...we just filed the I-129f last week or so to back it up...hoping for the I-130 to go through tho, but yes we all have been through alot, including our beloved GOGO and lets just drop the bump in thread and keep wishing each other good luck and keep learning....timelines are important to all of us, but for the August forward peeps, we can not really go back and judge from previous time lines for the rake on the increase did somewhat of a glitch in that issue. But wait willing to hear this one out, but I do believe we just happened to hit a hurdle on the track with our timing. No fault of anyone on this site. USCIS is another story tho.

Hopefully people after us will not have such a long wait in receiving that NOA1 - and within the next six months things can settle down to a normal process....whatever that maybe. I gotta apply to USCIS charm school to understand etiquette.

I can absolutely understand why all the K3 people are reading this forum and posting here. I read the K3 forum also.

However I have to admit that like James I've found it confusing to read something posted on the IR1/CR1 forum and then realise that it's not information that is relevant to me. It's relevant for a K3 person, but as I haven't filed for that kind of visa I can't use the info to judge.

This doesn't mean I'm asking anyone to stop posting, it's great that you're all doing the research and posting so other VJers can benefit. What would be good is to clearly identify that it's info for someone who has filed a K3. When you post in the IR forum, on an IR thread with K3 info you get people confused, as was shown by the confused posst of a member that started this whole debate.

I do acknowledge the overlap. But agree with James that the forums have become a little more intermingled recently, which can cause confusion. USCIS confuses me enough as it is. :D

i have the same situation.. go to the passport agency close to you in india with your marriage certificate and birth certificate and they will change the name for you, tell them you want to apply for a new one ... now it only take less that a week to get a new passport in india.

in my case i used my wifes maiden name and she just had to endorse that i am her husband in the passport with is a seal and my name and 1st magistrates signature

Ok heres a question and I dont really want to start another thread as this seems to be my home base.

So for those of us fortunate to have received a NOA1 and whether it be from CSC or VSC (yes we know postemarked Chicago) but heres the question - Looking at USCIS timeframe, and yes bumps head against wall, promised not to do that anymore, but CSC and VSC still show diddly squat for I-130 applications being moved forward - i.e,, sitting on July 2007 for VSC and August 2007 for CSC - this has not changed for months fyi......

So now that we have a NOA1 - what timeline are we looking at- in other words if applications are being scanned, what is actually going on in Vermont and California that there has been no movement whatsoever -

Challenge anyone ???? I promised myself darn I would not even consider their website anymore, but went in to look up NOA1 number and I know its not in system yet till end of month at least, but glanced at CSC and VSC and was just thinking........what are they doing??? :angry::angry:
