Finally had my check cashed today, still waiting on NOA, hopefully that will be coming along in mail as well

OMG YOUR GOOD MATE WEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEEE

the NOA1 will come shortly but I still cant put my EAC number in yet on USCIC I still get that funny response that case does not exist yet, whatever dont care about that until next month,. So your good to go........plus your EAC or whatever number is on back on your check if readable-

Shoot sorry mates but dumb question of the day here and I know I know I was going to be good...

On our I-797C Notice of Action which by the way is in a frame above my work desk lol, it says something that I said hmmm........but think I know what it means but want someone to confirm.

on the fourth paragraph down it states the following....

If this case is an I-130 Petition - Filing and approval of a Form I-130 for Alien Relative (sigh hubbie is now an alien lol) is only the first step in helping a relative immigrate to the US. The beneficiaries of a petiion must wait until a visa number is available..blah blah blah blah...

Ok so I know that this is a standard form for different family members, but sorta misleading to someone not familair with the immigration laws of a spouse of a USC - there is not Visa number to wait for.....or did they change this in the last few weeks. Sorry sick humor.......

Was just thinking that it is so misinformative to say that instead of what is really going on. Dunna know any comments from the peeps that have that great wealth of wisdom here?

and hopefully USCIS updates soon so we can start tracking our progress but thats another story another month.

For family based petitions, there is no waiting for a number for a spouse. Once you get approved by USCIS your petition will on the way to NVC.

First trip 01-17-07

Married 02-05-07

What Service Center was filed at? Nebraska transferred to California

Provide dates for the following:

I-130 sent (Mailed)..........................3-12-07

1st NOA (Receipt Notice) .................3-29-07

2nd NOA (Approval Notice) e-mail.....6-15-07

Bill for I-864 processing fee rcd and sent..7-24-07

I-864 Packet Received......................8-18-07

For family based petitions, there is no waiting for a number for a spouse. Once you get approved by USCIS your petition will on the way to NVC.

Timeline

I am wondering if they are still processing July K3. If I receive my NOA1 for 1-130 in Jan 08 and send I-129F in Jan 08 then I have to wait five months for my K3 NOA2 because they are still processing mostly July and some leftover from May & June. Then what the purpose of issuing I-130 NOA1 with a back date? Any suggestions?

Well this makes me think I should divorce July and get together with August. I am a faithful devoted follower when lead down the righteous path. :innocent: I have sent my lawyer two emails requesting information in the past week he has not responded. I always just think emails are easy so he can get back to me when he is available. There I go being to considerate. :angry:

I think he is waiting for our K3 to be approved, which is why he is delaying the afidavit of suport form. :whistle: i should never make assumptions, but i want my case in my hands. Hecan go on his merry way. My brother in-law does not know if that is a good idea.

I will keep up with both threads I guess, since I am just starting to get used to you all. :thumbs:

Congradulations on your NOA1!! I am in September, because that is my reciept date for my NOA1. It ususaly only take a week for the NOA1 number to be issued I thought. I noticed that you all were having difficult with something being wrong with the process? Does the late reciept date holdup your petition that much longer? Or was it just the issuing of the number that was held up?

The I-130's were put on the backburner for quite awhile so they sorta bunched them up and sent them to Chicago for processing. There is the contractor who is now speeding up the NOA1's and yes the timelines have been so outta whack compared to the I-129F's and other forms.

There are alot of I-130's from late July and forward,......and forward.....and forward that have not received their reciept numbers because of this backlog. Hopefully the rest get caught up soon, Gone with the wind on those days of getting a NOA1 in 10 to 30 days.

Will it affect holdup for petition for being processed longer , uncertainity there, and not even going to guess, but will look at the positive side and think maybe just a little.

Well your checked being cashed pretty much is your NOA1. So just get the number off the back of the cleared check and you have your petition number.

I guess I am a bit confused by you guys who are filing K3 visas....I thought that once you started the K3 process you can no longer go back to the CR1 process. Is that not correct? I thought this was the new rule since end of July. That is why there is no longer a K3 fee, and that is why you don't have to wait for the I-130 NOA1. I thought you are supposed to send both i129F and i130 together now...and that starts the K3 process.

I'm confused :wacko::help:

My lawyer mailed out my K3 pettition 2 months after my I130. My I130 was approved 2 days before the recieved my K3 petition. So right now we are moving forward with the CR1, but hope that the K3 gets approved and or some godly reason they will alow us to but the CR1 on hold.

Nigeria has a long wait for the CR1 interview. About 6 months from the NVC completion.

Oh I see! I guess its different depending on what country you are petitioning for. Otherwise I would think that you would want the CR1 over the K3 cause its a better visa and cheaper....but if it keeps you and hubby apart for so long then the K3 would be better.

Nope, I checked with USCIS and also sent my 129F, but they sent my 129F back and said wait for NOA1 from the I-130. So, I am waiting.....

Yes I wanted to go the Cr1 route once I figure out the error. Then I came across someone who's case was completed by the NVC in June and still does not have an appointment. That scared me so now I am praying on the K3 again. I want my husband here asap as most do. His time here with his family is worth the extra money ad hassle.

If he lived in Jamaica I would be there waiting with him. *wink :dance: That is my next vacation destination.

How did you find out the waiting time in embassy? I am trying to figure out the time difference between K3 and CR1. My friend told me that after it leaves NVC and reaches the native embassy it takes the same time to get the interview. It it true? any idea?
