i just married a girl for Poland who is here on a work visa which expires in Feb. 2008. We are trying to get her a green card and then we will apply for citizenship. Getting her a work permit is VERY high on our priority list as she is ready to get back to work and the extra income would be VERY helpful. We have been talking to an impatient attorney who is the only one fluent in immigration law in our area, but he does not like to take the time to answer some of our questions. He has given us a list of things that we will need to file including copies of my last three years of tax returns. This is a major problem. Are these required? Can somebody point me in the right direction?

My N-400 timeline, I hope it will help - Local Office (Chula Vista Field Office - San Diego)

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

you'll be in trouble if you can't present your tax returns

I was really close to hiring an attorney do help us, until i decided to do check online to see what do people who go through this process think about using lawyers and the likes... turns out most of what i saw was that everyone thinks the process is simple enough that you can do it yourself, and a LOT of people had serious complains about the lawers they hired, so we decided to do it ourselves.

so, i guess unless you have some complication like criminal antecedents and stuff, you could try do do it yourself

09/aug/2007 - I-130 Packet received

19/sep/2007 - NOA1 receipt date

25/sep/2007 - NOA1 arrived

23/apr/2008 - APPROVED

Timeline estimated adjudication on March 4, 2008. It was adjudicated on April 23.

Our I-130 was approved in 258 days.

09/oct/2007 - I-129F Packet sent to CSC

10/oct/2007 - I-129F Packet received

12/oct/2007 - NOA1 receipt date

20/oct/2007 - NOA1 received

23/apr/2008 - APPROVED

Timeline estimated adjudication on April 4, 2008. It was adjudicated on April 23.

Our I-129f was approved in 197 days.

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

24/mar/2009 - NOA for AOS and EAD date

What exactly is the problem?

1. If not having original transcirpts from IRA is a problem that it isn't - you send copies of your W-2 forms and before the interview, you send a request to IRA to send you transcripts which you take to the interview (and from what I remember, they don't want to keep the original, if they even looked at it)

2. If you didn't work, you have to get someone, whom you could show as her sponsor (parents?) and you will need this person's tax returns. Of course, you cannot sposnor anyone if you do not have your income.

3. If you didn't file for tax return, then you should do it ASAP.

4. If there is yet another possibility, let me know if you wish so :)

They are required and they are very clearly listed as documents necessary for the interview and before, for AOS application.

As for the lawyer - we did everything ourselves although it took about 2 weeks. You need to be very careful and read instructions that proceed the application itself (which you download from the internet).

I had very good results with my attorney.

The end result is he got my I130 approved!!

Past that; all attorneys are not created equal! So results will vary.

Please tell us what your tax return problems are so we can instruct you properly

December 12 2006 Filed I130

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!
