Emergency Leave out of country before receiving AP

Quick question for comment. Although we have applied for an AP, my wife's grandfather is close to death and we are wondering what we can do to expedite the AP process, or what consequences we have to face if she returns to her home country (Portugal) before we receive the AP.

Any comments or suggestions would be greatly appreciated.

If you leave the US before having the AP papers in hand, she will be classified as having abandoned her AOS process, and you will then have to file the paperwork for a spousal visa. AP papers are needed for her to re-enter the US.

You can try for an emergency AP. You'll need to schedule an appointment through INFOPASS, or try going to directly to your district office and see if they will let you in without an appointment (it may depend on if the security guys are in a good mood or not). It would help your case significantly if you have an official document from the hospital or doctor treating her grandfather explaining the gravity of the the situation.

It will help if you share your district office -- maybe someone has had to try this already and can give you any helpful advice based on their experience.

You need emergency AP. Don't leave the country without it. In most (if not all) emergency cases, the AP is granted by the local office, according to people's experiences on VJ. But you need to have good documentation.

MAKE AN IMMEDIATE INFOPASS APPT ... BRING PROOF / DOCUMENTATION OF IMMEDIATE NEED (LETTER FROM DR / HOSPITAL ETC.)
